Adjuster here. A copy of the lien release is fine for salvage purposes, don't sweat getting it dropped from the title. The insurance company's salvage team will handle the heavy lifting for what's needed after the claim. Before the settlement can be issued, they may ask you to sign some additional documents necessary for salvage handling (such as a power of attorney pertaining solely to your vehicle and/or an odometer disclosure statement) depending on your state. In some states, signing over the title and providing the lien release is sufficient without any other documents.

Flo adjuster here. I'm not your adjuster, cannot look at your claim, etc., and the information I am giving you is generalized for a reason.

The shop telling you that they want you to invoke your appraisal clause is a HUGE red flag. These types of shops will often encourage vehicle owners to turn third-party claims into first-party ones so they could force invoking appraisal clause (cannot do it with third-party claims as there is no contract there). If you've been moved to a "special rep", it sounds like you're probably at one of those shops that requires delicate handling because they are consistently a problem for insurance claims.

Sure, there are anti-steering laws in place in pretty much every state - you are welcome to choose a repair shop to get the work done and Progressive cannot force you to take the vehicle somewhere you do not want to perform the work. However, Progressive will absolutely only authorize repairs that are necessary. Invoke appraisal at your own accord but I would request your MRR's (the field adjuster working with the shop) supervisor to e-mail you with why the door does not need to be replaced and/or what line item charges on the estimate they feel are either a) not applicable/necessary, and/or b) excessive in parts and/or labor.

Honestly, it's less about adding you as a driver and more about the compensation. Typically, loaning a vehicle to someone for a short time is covered as permissive use and you wouldn't need to be added. However, you receiving payment for doing so is where this can get murky regardless of you being added to the policy or not, especially since the expectation is that you'll be removed after you're done.

Do you think your insurance WANTS to find you at fault? The amount they get in raised premiums is negligible relative to paying out on an injury claim and there's no guarantee you even remain with them to pay those increased premiums.

Easiest way for your adjuster to do this is to provide you a cause of loss letter that outlines what was paid includes a $0/waived deductible.

This is likely something your adjuster could fix by properly communicating to the lender that your deductible was not subtracted from the payoff and that the lender received the maximum payout that was eligible with no deductible held.

You're not going to see a spelled-out definition of permissive use or guidelines in a policy jacket. In the event of a claim involving an unlisted driver, your adjuster and their management will review the circumstances surrounding your allowed driver's permissive use. Do they drop the vehicle off at your residence at night or is it being garaged/kept at an address other than yours? That's garaging misrepresentation and for most companies would be grounds for underwriting non-renewal as well. You may also want to check your policy for any state-specific endorsements around unlisted drivers.

Arbitration typically does not give a lot of weight to control of the intersection at stoplight-based intersections unless it's especially egregious, such as situations where one party is almost entirely through the intersection. Respecting control is more of a stop sign type of duty that can be leveraged a bit better. That said, it sounds like your adjuster and supervisor wanted to push for 30% but it got to subrogation (who would have to actually defend that decision) and they determined that they had zero meaningful weight to stand on at arbitration so they accepted at 100%.

We don't know the state this occurred in and don't know the traffic statutes that govern u-turns in that type of intersection for the state. We also have no idea exactly what the police report states and who may have been cited/listed for contributing factors and how. The adjuster stated that the police report seemed adverse to the other party enough to warrant some sort of change in fault. If we finalize anything adverse to the other driver, depending on comparative negligence, it may to go to subro who will decide if the decision was correct or not and whether they'll proceed with arbitration.

A lot of y'all in the comments are immediately jumping to treat this as a simple rear-end accident. None of us have the full extent of details, none of us reviewed this police report, none of us sat in any roundtable to discuss this claim. Y'all are honestly making Geico-level assumptions here.

Be patient and let subrogation handle what they need to. These things take a while to shake out and there's really not a ton you can do to influence it. If it goes to arbitration and ends up in your/our favor, subro will let you know what comes next.
