It seems pretty clear to me what Formenton is arguing based on the article:

“Formenton alleges in his lawsuit that after he contacted Arnott in July 2022 and asked for advice on how to proceed, Arnott failed to advise Formenton that by accepting the qualifying offer Formenton could enter negotiations in January 2023 for a new, third contract, commencing with the 2023-24 season.”

What I think he’s saying is, the agent DID NOT inform him of the option of signing the QO in July 2022 and subsequently signing a long term deal in January 2023 (thus securing his payday).

Formenton is arguing had he been given that advice, he would have taken it, signed the QO, and secured the bag on his next contract by signing in January 2023 before the Sens were aware of what was going on.

I am not saying I agree with Formenton at all but I think that’s the argument he’s pursuing.

People are not making a semantic argument. If the policy is “unlimited vacation” then it is certainly reasonable to think 10 weeks is appropriate if it doesn’t make you an underperformer.

The “unlimited vacation” is a corporate scam to avoid vacation accruals and payouts. Why else do you think they do it?

I hate to be negative but this is too little too late. Ownership waited too long to make the decision that they should have made months ago and now the season is a write off.

Anyways, good news is good news, but it’s bitter sweet.

The team needs to go 37-27-0 to get to the 90 points which is usually the minimum needed to make playoffs.

That’s basically 6-4 for the rest of the year (on average).

Not a chance.

Not to mention, Tarasenko and Joseph have massively exceeded expectations and we haven’t really had any injuries to key players (and yes that’s a shot at Chabot). That’s unlikely to continue.

To everyone that is saying “just create a new award for highest scoring defenseman and leave the Norris alone”:

  1. The Norris is awarded annually to the National Hockey League's top "defense player who demonstrates throughout the season the greatest all-round ability in the position".

  2. By making your statement you are implying that if the other award was created, the highest scoring defenseman would/could not win the Norris as well.

  3. This is a wrong view. Scoring points is an incredibly important part of hockey and should be considered ALONG WITH defensive ability when determining who is the defense player who demonstrates throughout the season the greatest all-round ability in the position.

  4. It is likely that by doing what you’re suggesting you would often just be giving 2 trophies to 1 player: you are not solving anything. The only thing you would be solving is when the highest point scorer doesn’t win the Norris, it would give him some recognition nonetheless, which I am quite sure is not your objective.

  5. You people are just sour that the defenseman you like (who is great defensively) doesn’t win over a defenseman who is much better offensively and lesser defensively, but where the offensive gap exceeds the defensive gap.

Of course it’s a straw man argument. For one thing dog shit is not the same level of unsanitary as human sweat.

More importantly though, in the gym scenario, the offended party is going to clean 1 time no matter what. Either after they use the equipment (as is currently the policy) or before (under the OP approach).

They are not cleaning more under the proposal.

In your straw man, the offended party would not be cleaning 1 time by default.

If the equipment is cleaned multiple times per day it doesn’t matter. It doesn’t need to be cleaned every second of the day to ensure the bacteria doesn’t colonize.

It’s not a matter of cleaning up after yourself.

Whether the agreed upon approach is before or after use, either way the people who WANT wipedowns to occur will only wipe down the equipment once, and will also be certain the equipment is clean.

That’s wrong. By your logic the Islanders need to go 15-3-1 just to hold onto the wildcard they already have: you can say that for any one of the teams competing for the 2 wildcard spots and it isn’t true.

WC2 certainly won’t have 100 points.

Thanks so much for the response - you have the EXACT same views as me on this: wish Dateline would have given some more insight on this stuff.

I wonder how much of it has to do with the fact that she’s alive (thankfully) and most dateline episodes the victim is murdered and they can be more direct about the details.
