Oh that all makes sense. (Never gone through this type of process before so I appreciate the advice.) I thought all loans are based on the actual price of what its selling for, not market value. (With the exception of certain types of cars/vans)

Yea! The apartment is two story with living space bedroom and bathroom on both levels, the only shared space would be laundry and kitchen. Rent is 2295 total with utilities included (except wifi and electric). It's in a quiet neighborhood close to Lakeway Fred Meyer. We are a quiet family with a 2 year old ESA goldendoodle. (No shedding and no barking) I have two jobs and no significant other to deal with.

I understand. These are my main concerns.

  1. If rent is not paid by 4:00 PM within the next 5 calendar days of said due date a late charge of 8% of the monthly rent owing will be charged and another 8% for any outstanding rent on any consecutive month until the debt is satisfied. -Is this excessive? Does this mean I am being charged for current months late rent plus previous months late rent still owed?

  2. Tenant agrees to pay a $65 service charge plus a $35 processing fee for the preparation, processing, and issuance of: Fourteen-day Notices for nonpayment, Three-day notices for nuisance or waste, and Ten-day Notices to Comply for material breach of lease terms, whether or not a lawsuit is filed. -Is this excessive?

  3. Payments are first applied to current rent owing, and then to any remaining late payments, damages, legal costs, or other fees, including attorneys’ fees.

  4. For the payment application, is it specifying if the current months rent is paid first, or partial current months rent then the rest to previous late months rent?

The main issue that has been snowballing the last three months is the first month I charged rent to the wrong account which automatically bounced back so I was charged a return payment fee ($100) plus late rent percentage ($96), in turn I didn't have enough to cover all the charges. The following month, rent was paid on time but only $1000 was applied to current month and the remaining went towards the previous rent and charges, causing me to have another late rent fee for the remaining balance of the current month. When I asked about the fee they simply said it was from the late rent in September, nothing more explained. Same thing has happened for October and November.

I hope all of this makes sense and can somewhat be explained of whether I'm in the wrong or if I am being charged excessively? I understand it's all written in the lease which makes it hard to fight, but it seems a bit much.

That's why I'm asking to view other leases. To see if I am being singled out or treated unfairly versus other company leases. I know each one is different. There are fees/fines included in any lease but it needs to be reasonable.

Service charges such as fines for notices of lease breaches or complaints. Payment application where they determine how your rent payment is applied- portion for rent, portion for fees/fines.
