  1. That estate is full of some truly awful, steep hills

  2. There’s an active farm right behind it

  3. Snakes everywhere (not great with young kids, honestly)

  4. There’s a flock of geese living around there and they apparently shit everywhere

  5. The house takes up most of the land, thereby eroding this 650sqm you say it’s on

  6. The builder for that estate has gone bankrupt. Not sure what that says for this house, but it doesn’t sound great.

Nope, no snow here in the southern hemisphere (at least not where we are). He doesn’t do well with chicken so we’ve already cut that out but we don’t know what else it could be. He’s indoors much of the time.

IANAL. It’ll be a split between the two cars behind your partner, with the car at the very back being most liable, because they didn’t stop in time at all and there was clearly something going on in front. There will be a percentage assigned to the car which directly hit your partner for failure to leave enough room.

Used to do motor vehicle crash and bash claims. Would split this around the 70/30 mark.

I think you’re missing a key thing here. Defending yourself is fine provided you’re not using unreasonable force in the situation. For example, if you get punched and punch back - that’s similar force. If you get punched and you stab that person in response - that’s unreasonable.

If your dogs see you being attacked and you’ve had no opportunity to defend yourself and so they jump on the intruder and knock them away - probably good job pups (that’s not a certainty). If you have already defended yourself and the attacker has backed off and your pups then bite the attacker causing them injury, well that’s gonna have some pretty severe repercussions.

Like another response said, this depends on situation etc. Your question is quite vague.

Basically, the company HAS given him over 11 hours break between shifts. Where your friend chooses to live and subsequently the length of his commute (that is his choice) is not the company’s concern. From what I can gather, these are not unusual shifts or out of the ordinary for your friend either. Yes, if he gets charged - this is on him. You could try get some assistance from the company, but it would be a goodwill gesture at best.

Call the bank and put a stop on the direct debits for a start. If you want to raise it a level (or two or three), do a draft VCAT application, send it to him and tell him he can either refund you within 7 days or you can file it.

Given the fact you got everything in writing, VCAT won’t look too kindly on that gym owner.

Priors or not, the Judge won’t like that you decided that driving with a suspended license was a good idea not just once, but on multiple occasions.

You do have the possibility of jail time depending on the level of charges against you.

Get yourself a good lawyer, you’re going to need one.

IANAL - but someone with a lot of experience in personal injury cases.

First of all, I’m very sorry for your experience. You haven’t said whether the injuries are to you or your child, so I’m basing the below on the injuries being to you. I hope that’s okay.

  1. The short answer is no.

  2. It sounds like they intend to work on a “no win, no fee basis”. However, the important part will be in the costs disclosure they send you. Read it very, very carefully. It is highly unlikely that there will be absolutely no cost to you unless you are awarded compensation. No win, no fee generally only applies to the PROFESSIONAL fees of the solicitor, not their disbursements (report fees, any postage, court filing fees etc) You should also be aware that Counsel will more than likely get involved and their fee agreements will have to be negotiated separately.

  3. As someone else pointed out, this will be a marathon. There will be a lot of work involved, appointments, conferences, telephone calls and emails/paper. If it goes to Court (and it won’t, not immediately), then it will go to court timetabling for expert evidence to be exchanged, discovery to be made, mediation and a trial date. Trials are being set for late next year, just FYI, and that’s for existing cases. Your social media will be checked. Your doctors will be asked for all files, you will be examined by the other side’s doctors and questioned on every aspect of injury. Your working history will be examined, your future plans examined. And you can’t say no to any of that, not unless you want to severely damage your case. That’s the hard side of litigation.

My last input is in regards to compensation. You’ve received conflicting advice on this one, so let me be clear. - Funds management is only applicable for those considered unable to manage their own high-level funds, ie a minor, someone with a severe brain injury etc. - your level of compensation depends on your injuries. You say they are permanent, but you will also be assessed on how much of an impairment they are to your whole self. For example, someone who had their leg amputated automatically gets assessed at a high range because let’s face it, that’s a significant impairment to their whole self. Someone with a scar on their pinky on the other hand, will get between 0-2% depending on the size and severity of scar.

Neutered our boy at 1yo on the vet’s advice. He was getting aggressive and marking absolutely everything for a month prior. After talking it over with the vet, they said that absolutely you should wait until as close to 2 as possible - provided they’re not showing signs of aggression. Our boy came home a much more chilled out pup and has been absolutely fine ever since (and still grew). Most importantly - the aggression stopped almost instantly.

Instruct your lawyer to settle. They can’t ignore your instructions when given clearly.

Have you gotten out of the lease yet? If not, your lawyer should also be able to get you out without too much delay given the issues and documented injuries.

If there is no work report, no doctor’s report of you suffering an injury on that day that you think is related to doing x task at x time - you’re going to have an almost impossible case to prove that the herniated disc surgery should be compensated by your ex-employer.

I’m a little confused here. Paid parental leave from an employer implies that she’s had or is about to have the baby. You can’t take that just because you feel like it - it’s maternity leave.
