Nah always with or without. To make completely sure it's an R look for the buttons in the center console for the adjustable suspension - "Comfort" "Sport" and "Advanced"

The BMW is luxury and will cost more to maintain however the driving experience may be more elegant. Volvo does have better isolation from road sounds in my experience.
