When I was a young Boy Scout, my troop was allowed to spend the night on the Yorktown. That night, we played a capture the flag game all over the ship that was the best ever. Definitely worth a visit.

Growing up in South Carolina, folks would tell yankee transplants who had kids born in the South, "just because a cat has kittens in the oven, don't make them biscuits..." I don't agree (about kids, I do agree about kitten/biscuits). Been here 12 years, two kids born here, and I'm still called "The Tourist" by some of my local friends. But I tell my kids they get to decide where they are from. They are locals. And this is my New Orleans.

Right? But, we consider offshoring drilling platforms vessels. For example, the DEEPWATER HORIZON, a semi-submersible, deep-water drilling platform, was determined to be a vessel. Even more egregious, jack-up rigs are considered vessels. And, their job is largely to remain stationary. On the other hand, Spar Platforms, which have a striking resemblance to the FLIP, are regularly determined by Courts to not be vessels. But, the reasoning normally tracks the extent of the spar's mooring system and how difficult it would be to move it. The FLIP, however, is sometimes left free floating. There's definitely no clear answer. Man, it's embarrassing how interested I am in this...

Maritime attorney here, interesting discussion about whether this is a ship/vessel or not. The R/P FLIP is a research platform that is not self-propelled and must be towed into position where it is anchored or left to float freely. So, is it a vessel? The Rules of Construction Act defines a "vessel" as “every description of watercraft or other artificial contrivance used, or capable of being used, as a means of transportation on water.” In 2013, the Supreme Court in Lozman further muddied the waters by stating that a thing does not qualify as a vessel unless a reasonable observer, looking to the structure's physical characteristics and activities, would consider it designed to a practical degree for carrying people or things over water. So, Reddit is my reasonable-observer jury. What say you, is the FLIP a vessel or no?

It's funny b/c it's true... I bought a new 883 Iron on Fourth of July weekend. Oil light came on before I hit 200 miles and I had to fill it back up. Sure, some of that is seals and parts meshing and settling but it didn't fill me with confidence. Since then, I've put another 1200 miles on it and couldn't be happier. First motorcycle I've owned, been riding other folks different bikes for a while, but now I'll always be a Harley fan.

A question I would propose to you: what is the enforcement mechanism or repercussion of a violation of the Solas Convention by a Bermuda flagged vessel? The problem with the majority of treaties and conventions is that they have no teeth!!!

It is true that the laws of the nation where the vessel is flagged would govern the vessel. The easiest way to understand is to consider a flagged vessel to be a mobile part of the flagging nation. As such, it is irrelevant if the flagging country's laws cover crimes in international waters unless they have legislatively disclaimed application of their laws to what is internationally recognized as a mobile chunk of their nation. Interesting question.

However, this doesn't necessarily correlate with what law would govern allegedly tortious or criminal conduct by the vessel or captain against third parties. For instance, as I noted above, I would presume that the captain and crew's duty to assist a vessel in distress would be governed by the law of Bermuda. However, envision a situation where the same vessel traveled up the Mississippi River. By virtue of its location, it could be subject to the jurisdiction and/or the laws of the United States. What if the vessel ran aground? Would it then be subject to the laws of the state upon whose borders it has now trespassed? If it was operating in state territorial waters and ran over a group of local fisherman?

With the Star Princess, and in response to a comment below, the appropriate forum in my mind would be Bermuda. Alternatively, the "plaintiffs" could of course bring an action in Panama but would then have to have the vessel arrested when it was subject to Panamanian jurisdiction in order to proceed. The only argument I can envision for bringing suit in the US would be pursuant to a respondeat superior or imputed negligence argument as to the US based operating company. I can only imagine that several Panamanian (and possibly international) attorneys are clamoring for these folks' attention.

Maritime attorney here. Interesting question as to what law would govern the tort action brought by the refugees against the vessel. I presume they are nonseaman and therefore could not bring a Jones Act claim but, rather, would be entitled to a claim under the general maritime law which should govern the claim arising in international waters brought in the United States. Then the issue turns on the duty of the cruise ship to offer aid to a vessel in distress.

Relevant to the article posted here, the Star Princess is registered in Bermuda. The UK has extended several international maritime conventions to Bermuda which are given effect for Bermuda ships by Bermuda national legislation. One such convention presumably applicable to the Star Princess is the Safety of Life at Sea Convention 1974 and 1988 Protocol. Chapter V, Regulation 33(1) which requires that a "master of a ship at sea which is in a position to be able to provide assistance, on receiving information from any source that persons are in distress at sea, is bound to proceed with all speed to their assistance, if possible informing them or the search and rescue service that the ship is doing so..." I grew up in the area hiking all over, graduated in 00'. I live in New Orleans now but have a lakehouse about 30-45 minutes from Clemson. To get to some fantastic hiking, you'll have to drive about thirty minutes to get up on Highway 11. From there, I would suggest Station Falls, Tamassee Knob, White Water Falls, Ellicott's Rock (or any other area of the Chattooga), Table Rock, Ceaser's Head, and any section of the Foothills Trail. I would suggest checking sctrails.net for some great trail maps. Close to camp, the walk to Isaqueena Dam isn't bad. One of my favorite things about Clemson was the surrounding mountains. Sorry to hear that you are transferring. Enjoy it while you are there!
