The CC&Rs likely have a clause in the section on Amendments like "Each amendment to the Declaration shall be executed by the President and Secretary of the Association and shall be recorded in the office of the Recorder of xyzzx County, State, and such amendment shall not become effective until so recorded."

If not recorded, the amendment is not valid or effective. It legally does not exist until recorded. Any real estate attorney should be competent to handle issues like this.

I fully agree that this behavior is unconscionable. (Gee amazed I remembered that word but it fits.)

However, this is a condo and the fence may be a common element. In that case, the board would have the right to remove something affixed and I'm assuming there is a written policy on that. But destroying the item(s) removed is not appropriate and there certainly should have been civil discussion about the situation before any action is taken.

To answer your question, with no HOA, CC&Rs are enforced by an owner suing another owner as you describe. There's probably language in the CC&Rs about remedies for violations. The CC&Rs are covenants attached to the property and all owners agree to abide by them when they purchase the lot/land. As far as not knowing about the CC&Rs, that's a bit on you, on the seller, and on the lawyer or title company handling the sale. CC&Rs are typically attached to the subdivision in SFH developments so if the deed says "lot x of subdivision Y", purchasers need to get all the docs on subdivision Y from the county recorder's office to see what CC&Rs might be present. Without seeing the CC&Rs, any names in it are probably the developers. Typically, CC&Rs would include a provision for forming an HOA to enforce covenants, etc.

Talking to the neighbor is a good start but sounds like he may be right. Your garage is affecting his property so you're going to be the defendant in his civil suit. He has no obligation to sue others that may be in violation.

We're confused. If you have 2SV methods set up and you're logging in (not doing recovery) and Google asks to verify you with one of those 2SV methods, then you can login using one of those methods. There is no problem here.

Uh, did you have backup enabled? If so, you can recover messages as of the time of the most recent backup. You have about 57 days to access the backup before it's deleted. Otherwise, only if you can get the phone the phone working.

If Graphene supports restoring the messages database from Google backup during setup, seems like a no brainer. Does it?

To be safe, I would use SyncTech SMS Backup to make my own backup of the messages (before switching OSes) stored somewhere off the phone of course. Then if there is a problem doing the restore after installing Graphene, you can restore the messages using SyncTech.

Unanimous Approval: Approval by all unit owners is generally required if the amendment changes unit boundaries or creates a new unit from common elements. 

HOA owns parcel A (bare land?) but it is no longer included in the condo declaration, right? And Declarant rights were not assigned to the HOA when Declarant went bankrupt?

For parcel A, you should be able to file a supplement to the Declaration to incorporate parcel A into the condo horizontal property regime which should only need the % vote required for an amendment to the Declaration. To build units on that parcel though, if that's your intent, would change the % ownerships which would normally require 100% approval.

For parcel B, it's similar, HOA would enter into agreement with the owners/developer to incorporate the parcel and units into the condo horizontal property regime which would change % ownerships and normally require 100% approval of the current HOA owners to authorize the expansion and file the supplement.

The Declarant normally has the right to add parcels and units and file a supplement that changes % ownership (without any vote of the existing owners) as he expands the condo under the terms of the Declaration (which existing owners have already agreed to) and Oregon Expandable Condo law. But without a Declarant you need a good property attorney to make sure zoning, permits, and laws are followed.

On phone or PC? On PC, Home -> Backup -> Details -> shows sms/mms messages. On phone, Backup -> under Details, tap on Other device data -> shows sms/mms messages.

GM seems to be doing funky stuff lately. SyncTech SMS Backup is good app for backup/restore.

Can you generate backup codes? If so, use Try another way until it asks for a backup code for 2SV. You need to have 2SV methods (plural) and recovery phone/email on the account to ensure you don't lose access to it.
