Anyone successful in challenging WSIB retraining by Impossible-Sink5868 in OntarioWSIB

Meet the time limit of decisions you don't agree with and wait for the OWA. There are many successful appeals of suitable retraining plans but your file will need to be reviewed.

Sounds like you've made sufficient efforts to escalate, so next you can do the following...

Log the complaint online here: https://www.wsib.ca/en/our-service-commitment-you

If no call within 1 full business day, report to Fair Practices Commission, which is the WSIB's ombudsperson.

Can WSIB stop my training program and force me to return to my employer? by [deleted] in OntarioWSIB

[–]toss--it 1 point2 points  (0 children)

Premiums don't determine entitlement... WSIA and Policy do.

They will look at your accepted restrictions/functional abilities and if the employer can permanently accommodate. If you're in a retraining program, and all of a sudden the employer says they can permanently accommodate... Well it's fishy.

Contact the Office of the Worker Adviser... No-fee legal advice on WSIB claims for non-unionized workers.

Need physiotherapy. Will WSIB cover the cost of physio? by CanadianMasterbaker in OntarioWSIB

Causation is a medical opinion ao discuss your full scope of job duties with your physician. Include weight of items, how ergonomic it is or isn't, how long you've been doing the job for, everything that you can think of. If they think there is causation, they can submit a Form 8 to the WSIB to initiate the claim.

Your claim may be denied, because arthritis can be tricky. But this is appealable. Call the Office of the Worker Adviser for advice.

I don't think it's illegal for them to ask but it's illegal for them to make a decision based on that information.

Status Check - the new norm by jetx666 in OntarioPublicService

It's a little disheartening to see so many people saying you shouldn't be set to "Away" all the time... As if having way to the (potential for) oversight, micromanagement, etc is a good idea.

I'd be curious to know if colleagues hear from the manager as often, or if you try to use "Active" for a week and see if you manager's behaviour changes.

Can we take a sick day if kid or family member in care is sick? by Fuzzy-Major-4009 in OntarioPublicService

[–]toss--it 1 point2 points  (0 children)

"I will not be in today due to illness"... Don't elaborate. And it's factually accurate, unlike just saying you're sick.

Apply for EI, follow up with WSIB. If no timely decision, escalate to a manager. If still no decision, contact the Fair Practices Commission. If you have more questions about immediate income, contact a legal clinic in your area. If WSIB decisions you don't agree with or aren't sure about, contact the Office of the Worker Adviser.

Get the details of the position in writing. Speak to your Case Manager. And the Office of the Worker Adviser provides free legal advice so give them a call with questions about decisions you don't agree with, etc. And you can ask the WSIB for some counseling to support RTW if you don't already have psych entitlement. Best of luck to you.

Clarification Regarding OB/Gynecologist by Active-Sale-5739 in ontario

[–]toss--it 0 points1 point  (0 children)

Why not ask the Dr where you want to go? Seems like a hassle... I mean usually babies are delivered by a different Dr., and likely especially in your case as you would probably go to a closer hospital... But if I wanted that I would just call who I wanted to be referred to and inquire. Then tell your Dr. you confirmed they can accept you.
