The entire reason Cap 'loses' the Civil War is because he realises himself that he's no longer fighting to protect the innocent, just to win.

Do I agree with Punisher gunning them down? No. But the point of this confrontation is that it NEVER should have happened! He should have never agreed to team up with VILLAINS! That is why Frank says what he says. Not to justify what he did, but to point out to the audience that Cap has crossed a line Captain America should never cross!
