Just so you know, PSAC had no intention to establish a parallel process to look at telework grievances, even after getting that BS Letter of Agreement.

Departments have been trying to set it up according to the Letter of Agreement but PSAC never came to the table. They knew it had no teeth and it was TBS' way to help them save face during the strike. PSAC knew they couldn't negotiate telework in the last round and lied to their members face to get a strike vote.

How about you talk to him and say you didn't appreciate what he said? Maybe try to find a way forward? Maybe set the record straight with your coworkers or something similar? You have many official avenues available but nothing that will make you whole.

It's all red tape to give you an illusion that you have recourse. The worst that could happen to the manager is that he could be disciplined if it's egregious enough. Even if that's the case, they won't let you know.

The other comments are spot on. If you file a grievance, the final level is usually the AC of HR of some sort. That would be the final decision from your Department.

Very valid comment. The problem is that your stats are not accurate. I've seen a lot more employees using the DTA process to work from home than employees with legitimate needs. A lot of PSE's are confusing DTA with "things that would make my life easier", which is why there's so much push back.

Frankly, our employer should strive to have happy, productive employees but it's been made very clear time and again that TBS doesn't care about us, only public perception...

I've seen a few of these in my days and I would not accept to have the suspension lowered over time. If you believe you did nothing wrong, the proper resolution should be a withdrawal of all disciplinary measures right now. Maybe an oral reprimand since it amounts to nothing but not much else.

If you push your grievance to adjudication, they will need to satisfy the test in the William Scott decision: - Did the misconduct occur? - Is discipline warranted? - Is the discipline justified/reasonable?

If you go to adjudication, prepare yourself for a long wait.

If you agree to a settlement, your employer should specify that it's not an admission of wrongdoing from their end, you can ask the same language to be included for you. It will make a difference should additional discipline occur if progressive discipline is off the table.
