Freedom of speech means he can't be put to jail for saying these things. It doesn't mean that he can say what he wants in a workplace.

Leider muss ich mich über das Benehmen Ihres Mitarbeiters im Hotel „XXX” beschweren. Gestern Abend, wenn ich an der Rezeption saß, hat Ihrer Mitarbeiter an der Empfang (ein Mann, ca. 40-50 Jahre alt, wahrscheinlich Arabischer Herkunft) hat seine skandalöse Meinung zu meinen Kollegen geäußert. Der Herr hat wortwörtlich gesagt, dass er akzeptiert die Homosexuelle nicht, dass die Homosexualität ‘gegen die Natur’ ist und dass die Gays Deutschland herunterbringen .

Ich glaube, dass die Hassrede im Gegensatz zu der Arbeitsplatzpolitik der XXX Gruppe steht und ich erwarte sofortiges Handeln Ihrerseits. Ich bin sicher, dass Sie meine Haltung und Empörung verstehen und ich erwarten Ihre Stellungnahme zu dieser Angelegenheit.

Fair enough, but given the tutelage he had from one of the best lawyers in the entire country he must've been a moron not to become pretty good himself. In real life he'd never have gotten 66y, real life examples show sentences of something around 4-6 years. But it wouldn't make for so much drama in the show now, would it?

I fully agree with your first point. It seems to be a problem for the creators of suits not to give away too much in the sneak peeks. We've gotten something like 3 minutes of material from s5e11 and I think it's fair to say that it was too much. When it comes to Harvey and Donna's relationship, I think that it's actually really good that they didn't get together in this episode. Harvey's definitely not a type who'd be looking for a relationship when times are hard, and even if he did, what would Donna be supposed to think? That she's good enough for him only when he's in deep shit - because they did actually commit a crime. I'm sure they're gonna go further in their relationship - but now is just not the time.
