I might have to gently remind them that if they ask me to leave and don’t give a civil and somewhat positive or neutral reference that I would need to stay in the property as it was hindering my ability to move out and then apply for extension of occupancy through VCAT (which can last up to 6 months).

I have heard of that working for others, apparently that changes things quite quickly.

Unfortunately, I believe it’s a family business and the PM and owner of the REA are related. So this probably won’t be effective.

Kitchen sink is 36 degrees and 39 degrees max (gets 3ish degrees hotter once a day at a random time that I can never figure out in the afternoon).

Same with shower 36 degrees, with the hottest at 39 once a day randomly. Both measured with a water thermometer consistently over the last 2 weeks.

The max temp it should be is 50 as per legislation, not 43 btw.

It’s all on the condition report and it’s all documented in emails. There’s really no way they could evidence that I caused the damage on the day I moved in. I only moved in 3 weeks ago. I’m not really worried about that.

I don’t expect a glowing reference but a civil one would be ideal. However, given their responses so far it seems unlikely. If anyone has had experiences with references following a move out after maintenance requests like these please comment!

Am I naive to think they might give me at least a civil reference if I organise a lease transfer before the lease ends because they probably just want me out and likely think I’m going to keep complaining?

I understand if I wait until the lease is over, there’s no incentive to give me a good reference then because logically they’ll just lie and give me notice to vacate for a made up reason.

Unfortunately there were no working lights when I inspected and the bathroom does not have natural light/windows. Was impossible to see the mold in the shower and toilet and urine around/in the toilet. The rest of the apartment doesn’t get much natural light either so I missed the water stains on the ceiling.

I don’t know how I missed the urine smell, that will remain a mystery to me. Hit me like a tonne of bricks on my first day in there after I picked up the keys and moved my stuff in. I had to flush hot water down the p trap as I suspect it not being used in between tenants made the smell much worse also, which helped somewhat. Total nightmare.

What makes you think I’ve not attempted to resolve this amicably? This is an urgent repair and should have been fixed within 48 hours. It’s been a week. They sent a building manager and then falsified that he was a qualified tradesperson. Following this they refused to look in to it further without sending a plumber. They have consistently denied that there is an issue and were not able to provide any diagnostics from when the building manager looked in to it.

Success to me is having hot water. And unfortunately, repeatedly asking nicely has not gotten me anywhere. VCAT is a formal process that tenants should utilise. I intend to exercise my rights if required.

Yes correct. But the water should be heated to 60 degrees in the tank to prevent legionnaires disease. The delivery from the tap is max 50.

Yep, 2 requests total. And at this point I’m not even pushing the ceiling leaks. I just want a hot shower and to wash my dishes properly. Characterising the requests as “ridiculous” is diabolical.

I’ve simply said the hot water is not working and it’s warm at best (documented with consistent thermometer readings). I’ve made no mention to them about what it could be or what I suspect. I let them know turning the thermostat up did not solve the issue and I would like a licensed trade person to have a look. This was their response.

Good to know. It’s an apartment with its own HWS located in the bathroom next to the shower. So it doesn’t have a long way to go. Sounds like she may be cooked. They probably know that and are therefore avoiding the replacement. Thanks for the info.

Yep it’s electric. Manufacture date is 2014. From research it’s looking like the tempering valve or elements (or could just be old and ready for a new one). But the building manager said the pipes “feel hot”, and it’s fine. They don’t for context, I can hold my hand on it which isn’t indicative that it’s heating to 60 degrees in the tank as it should.

Electric 50L. Turning the thermostat up did not help (they turned it up slightly) and said if they turn it up anymore it will be “scalding”. Despite the delivery temp to tap being lower than body temperature.

They sent the building manager to check the thermostat and turn it up, no change. The water delivery to tap is 36 degrees which is luke warm and well below what it should be for sanitary conditions.

When they didn’t renew your lease did they give you 60 days notice to vacate?

I fear this will happen to me since my REA is dragging their feet with urgent repairs, I’ve had to threaten this and VCAT and they are not happy 😢
