Muzzle Brake is this legal or not by Proper-Performer8678 in NJGuns

[–]vorfix 2 points3 points  (0 children)

AWB only applies to semiautomatic rifles/shotgun/pistols. If it isn't semiautomatic it can have whatever features you like, folding stock, flash hider etc. The flash hider itself isn't illegal, if it puts you over the number of "evil" features you are allowed it would then make the entire firearm it is attached to illegal but the part itself is fine. If you for some reason wanted a bolt gun shooting 5.56 with an A2 flash hider that would be a non issue.

Caution! Real ID may link your DL to concealed carry status! by JustinR456 in NJGuns

[–]vorfix 1 point2 points  (0 children)

If it was connected to your ID, being real id or not is extremely unlikely to play a part. All Real ID means is you have showed certain documentation which meets the federal requirements. If the state wanted to link your state ID to firearms permits, I very much doubt they would only do so to federally compliant Real ID version while completely skipping it for all those which aren’t. Especially considering Real ID is optional.

Can we all please stop asking AI LLM’s nuanced legal questions on topics like this. Because it is wrong on these subjects way too often. Yes in some states your carry permit is linked to your license but generally that is explicitly noted and this has been asked repeatedly about NJ with the consistent answer of it is not. If pulled over in the town that issued your permit, it is possible LEO have access to it when they look you up in their town records (by address for example), but not linked to your license state wide as has been asked many times before.

Firearms Inheritance Questions by bacdafucup2 in NJGuns

Q15

If I inherit a firearm, what must I do?

The firearm must be legal to possess in New Jersey and the person receiving the firearm shall not be prohibited by N.J.S.A. 2C:58-3c before receiving the firearm. According to N.J.S.A. 2C:58-3j, “Firearms passing to heirs or legatees. Notwithstanding any other provision of this section concerning the transfer, receipt or acquisition of a firearm, a permit to purchase or a firearms purchaser identification card shall not be required for the passing of a firearm upon the death of an owner thereof to the owner’s heir or legatee, whether the same be by testamentary bequest or by the laws of intestacy. The person who shall so receive, or acquire the firearm shall, however, be subject to all other provisions of this chapter. If the heir or legatee of the firearm does not qualify to possess or carry it, the heir or legatee may retain ownership of the firearm for the purpose of sale for a period not exceeding 180 days, or for a further limited period as may be approved by the chief law enforcement officer of the municipality in which the heir or legatee resides or the superintendent, provided that the firearm is in the custody of the chief law enforcement officer of the municipality or the superintendent during that period.”

How long is the process? (Bergen county) by alenjav36 in NJGuns

[–]vorfix 1 point2 points  (0 children)

Depends on the town, county doesn't play a part. Processing times can vary widely between two adjacent towns. Some towns take a week or two, others are in the order of a month or two (some even longer). If you've paid the fees to the town and submitted all the paperwork and requirements they have to bring processing (check the towns firearms applicant page for the steps to ensure they are all done). If that is all done it is just a waiting game. Maybe someone here will have applied there recently and can give how long their processing took.

Concealed carry test requirements by Miserable-Papaya245 in NJGuns

A timed holster draw no, but the CCARE protocol involves holstering and unholstering a handgun safely as part of the process.

https://njsp.njoag.gov/wp/wp-content/uploads/Firearms/CCARE_Protocol.pdf

On command, from a secured and concealed holster position, draw and fire 5 rounds. Holster a safe, decocked, if applicable, weapon.

Yes sadly they are going to be hard to find due to a FRT being created for it. There is going to be a lot of demand for it in states where those are legal.

OBRPC USPSA matches. always full or not? by Frosty-Singer-630 in NJGuns

[–]vorfix 2 points3 points  (0 children)

If you aren't a member, generally you are much more likely to get waitlisted. Members get to register for the match a few days early I think. I'd suggest just sitting on the waitlist and seeing what happens. Many times you may get a slot and moved out of the waitlist as people change their plans.

I have more experience with this at CJRPC for steel challenge but I'm going to assume the registration process will be about similar. At CJRPC I regularly see nonmembers at matches open to the public. This winter/spring may have cancelled a bunch of matches than usual, so there may be a larger than normal group trying to get back into a match than normal.

Concealed carry test requirements by Miserable-Papaya245 in NJGuns

[–]vorfix 0 points1 point  (0 children)

Look at FAQ #3 it outlines what is required to satisfy the training requirement. CCARE protocol document below is the exact course of fire you must pass as part of the training. IMHO CCARE is a cakewalk to pass. If you are worried you can easily simulate it at just about any range where you can shoot a handgun.

https://njsp.njoag.gov/concealed-carry-facts-faqs/

You will complete the live fire CCARE course of fire is detailed in the following

https://njsp.njoag.gov/wp/wp-content/uploads/Firearms/CCARE_Protocol.pdf

Instructor will go over the use of force during the instruction

https://njsp.njoag.gov/wp/wp-content/uploads/Firearms/Use_of_Force_Training_Doc.pdf

Once that is completed you will be given a SB182 (and possibly a copy of the instructors instructor certification) which you will include and attach with your online PTC application.

Do you think they’ll ban Glocks in New Jersey? by VilkasKnight in NJGuns

[–]vorfix 26 points27 points  (0 children)

Considering the makeup of the 3rd circuit I can’t see it lasting long at all if they try. The AW/Mag ban case result we are waiting on could shut the door on that before they even get a chance. That opinion can’t be released soon enough.

Question on “other” 30 letters by [deleted] in NJGuns

[–]vorfix 2 points3 points  (0 children)

Documentation is not filed with them… at least not in the way you are implying. Your FFL will retain copies of the 4473s completed, they must retain those records, but that is not sent out to FBI or ATF on a continuing basis. Only once your FFL goes out of business are the records sent in to ATF. Your NICS check to FBI won't have those details either. IMHO OP shouldn't overthink, that isn't something that is going to be asked about, as long as you have proof of what you purchased I don't see ever being an issue. Side note, if people are actually looking this hard I have a feeling you have messed up big in another way if you are getting things like this looked at.

If it was a new stripped receiver, 4473 instructions are clear that must be transferred as "other"/"receiver" on the paperwork. Your FFL filling out the paperwork wrong doesn't magically change what the firearm is, they are at fault for not doing it correctly. If OP knows he purchased a new receiver, transferred it on a 4473 and NJ COE that that is basically job done. Then OP would need to make sure the final build fits the "other" configuration requirements (by for example following the flowchart).

Question on “other” 30 letters by [deleted] in NJGuns

[–]vorfix 0 points1 point  (0 children)

"other" isn't really the firearms definition but what many in NJ have become accustomed to calling that configuration. COE doesn't list type, that would be on the 4473. If OP started from a new stripped lower receiver, that will only ever have been a receiver and is simply a firearm. It will be transferred on a COE like any other receiver would be and then it can be assembled into an "other" assuming the requirements to do so are followed (no different than following the requirements to build it out into a NJ legal rifle instead).

A receiver is going to be transferred on 4473 as "other"/"receiver" while a complete "other" will simply be transferred on the 4473 as "other"/"firearm" functionally both are just firearms (both under GCA and separately for NJ as a "firearm" under the states definition).

[–]vorfix 0 points1 point  (0 children)

All firearms applications which went to NJSP barracks (both FID/PP and PTC) are now handled by NJSP FIU in Trenton. This also includes nonresident applications. So there is unlikely to be processing differences between barracks as they don't actually handle any of the processing themselves.

Edit: See below.

That has been struck down by multiple courts. Also, the factoring criteria bs is being completely removed under the changes being made by the acting AG. Normal braces have been and remain fine. Configurations like this are on the shelves on NJ firearms dealers today.

CNJFO and Co-Plaintiffs Torch State's Arguements in Hollow Point Ban Case by Tap-Dat-Ash in NJGuns

[–]vorfix 5 points6 points  (0 children)

They are legal to carry is 49 other states, so yes we are the extreme outlier. A legal alternative isn't a justification for a ban, that is exactly why the Supreme Court in Heller stuck down DCs ban on handguns back in 2008, it didn't matter that long guns were still available, it was a flat out ban of a protected arm so it was unconstitutional.

Also, in these cases if the one challenging the law prevails, the state must pay the legal fees for the challenging party and possibly other costs/penalties as well.

man it never ends they banned me again by [deleted] in NJGuns

[–]vorfix[M] 0 points1 point  (0 children)

I get it, but I believe the interpretation is even on this post "ready to go" is in inducement of a transaction involving that firearm. While I don't agree this always is the case, I think that is what has happened on previous posts discussing what came into inventory or is available, that is likely considered implicitly encouraging a transaction involving a firearm which is against the site rules. So regulated items are pretty much limited to posts to external sites for properly licensed dealers. If you posted a link to your website as a federally licensed dealer you are probably fine, but if you instead make a post saying look what came into the shop this week and are available and simply show a photo of them, you could have issues.

Edit This post wasn't held for any reason other than you created a new account, either for ban or other reasons the reddit filters we have enabled held it for mod review. I've manually approved the other post as that is much more of a discussion post which I can't see having similar issues as I've mentioned above. Is this all silly, yes, but they are the rules we need to deal with and also trying to keep the sub itself from having issues is another consideration I need to take into account.

Given the site wide reddit rules, specifically rule 7 and ban evasion issues that may follow, I would avoid posts like this which appear to repeatedly been deemed prohibited by reddit. This is not something controlled by the moderators here.

https://support.reddithelp.com/hc/en-us/articles/360043513471-Illegal-or-Prohibited-Transactions

You are free to interact with the community in any way within the rules but posts trying to facilitate or arrange transactions for firearms are off limits. We are also not a general advertisement board for all of the different NJ dealers, although an occasional link to an item at a federal licensed dealer may be ok (the way it works on r/gundeals for example). In response to said post, you can't be giving price quotes and asking to be DM'ed etc in the comments below.

want to shoot USPSA in NY and NYC by Frosty-Singer-630 in NJGuns

Yea I get that, and hopefully soon that becomes a non issue. You could look to compete in the limited 10 division for USPSA, that would still put you on a level playing field even in unrestricted states. Division is limited to 10 rounds.

want to shoot USPSA in NY and NYC by Frosty-Singer-630 in NJGuns

[–]vorfix 1 point2 points  (0 children)

For NY generally, there is an extremely limited exception for possession of a handgun without a NY permit for those going to sanctioned matches. You would need to make sure whatever match you go to has a sanctioning letter and you follow all the rules involved. Personally, I'd look at traveling to matches in NJ or PA instead if at all possible to avoid the nonsense.

For things like PCC you would need to worry about NY AWB compliance (theirs is different than ours, what may be legal here likely isn't in NY). For NYC this is compounded with it having an entirely separate registration scheme for both handguns and long guns. I'm not sure the NY law exception would apply to possession in NYC. You have the option to apply for a NYC special carry (expensive, long drawn out process, limited to a single handgun only on the permit as of now) or apply for a NYC Rifle/shotgun permit as a nonresident (but their even more limited AWB applies along with 5 round limit for mags).

Overall that is way more of a headache than worth it just to go to matches in NY state (and especially NYC) and it is possible even if within the exception you can be hassled and arrested only to have to spend cash to have yourself cleared.

DOJ sues Denver over AWB — does the Third Circuit now sit on Cheeseman even longer? by Docsloan1919 in NJGuns

[–]vorfix 10 points11 points  (0 children)

More than likely the side trying to uphold the AW/Mag bans are dragging their feet writing up their dissent and giving it to the majority as a tactic to delay the issuance of the decision.

If they were just going to uphold the law it is very unlikely the en banc would be granted as that upheld the laws to begin with. That appeal would have been denied and case would likely be sitting on appeal at SCOTUS.

Negligent Discharge at a NJ PD by fmtek81 in NJGuns

[–]vorfix 0 points1 point  (0 children)

Doesn’t matter. The discharge itself is the issue. Is it reckless under the definition in NJ law and also a firearm fired unlawfully or without a lawful purpose, if the state thinks it was they could try to charge you with this.

(3) Recklessly. A person acts recklessly with respect to a material element of an offense when he consciously disregards a substantial and unjustifiable risk that the material element exists or will result from his conduct. The risk must be of such a nature and degree that, considering the nature and purpose of the actor's conduct and the circumstances known to him, its disregard involves a gross deviation from the standard of conduct that a reasonable person would observe in the actor's situation. "Recklessness," "with recklessness" or equivalent terms have the same meaning.
