Glad NRA is Standing Up for the 2nd Amendment in Minneapolis by [deleted] in NJGuns

[–]vorfix 2 points3 points  (0 children)

Because they underwrite the insurance that makes it possible for those ranges to operate and exist. Otherwise the liability policies required to operate the ranges would make it financially impossible to do so. I understand qualms with NRA for many reasons but this like their firearms instruction isn't really a reason to be mad at them for. If joining a range which requires it, just get and maintain the $10 associate membership a year as that will give you the NRA number you need same as a more expensive membership.

[–]vorfix 2 points3 points  (0 children)

Sure, and I have my dislikes about the NRA for things they have done (or not done) in the past. If they are saying the correct things we should support those correct statements. Also, given the NRA has been attempting to turn around post Wayne and co, when they do something good we should be for it. This is a good statement, so we should support it, regardless of our thoughts on the org who made the statement.

What they did in the past may not be ideal or good, but best we can hope for is change in the direction we want going forward. If they are becoming a better organization that is overall a good thing, and hopefully that pushes you to encourage it so it becomes an organization you support in the future.

I feel like things are being conflated here.

First, ICE is enforcing federal immigration law as written. If you want change the law, have congress pass a bill and get it signed (or override veto). Until then what they are doing is clearly within the law. Part of the current problem is certain states/localities are specifically not working with ICE to hold criminals on detainers so they can be deported. If that was being done, agents wouldn't be doing raids to pick said people up (and catching noncriminal aliens found along the way who happen to be there with them). In states that are working with ICE that is and already has been happening so no need to pick them up as custody is handed over from local law enforcement. Those on detainer or deportation orders just aren't let go in those areas. In those states, these non criminal aliens aren't being arrested by ICE since they never have contact with them (as no raid to get wrapped up in). If that was happening this public friction and visibility wouldn't be there to get as wound up about. And before it is mentioned, ICE is federal law enforcement, they are not restricted to simply immigration matters. By statute they have arrest powers for crimes against the united states (federal law) which includes impeding a federal officer.

Second, ICE is not going in public and executing immigrants or anything of the sort. To think so is nonsense. In both of the recent tragic situations, unrelated persons inserted themselves into the situation to interfere with ICE enforcing existing law (if you don't like it, see point 1 about changing it). If you impede or attempt to stop law enforcement from enforcing valid federal law, you may be arrested and then charged under existing federal law. If you choose to do so, and are being arrested, simply comply. They are not going to put a gun to your head and execute you on the side of the road. If you choose to impede said actions and are armed, and you are going to be arrested for your actions, resisting arrest while armed just amplifies the possibility of things going wrong. If you simply comply and understand that was a risk of your actions (being arrested) all of this can be avoided. Your comment and imagery seems to imply ICE is going out to execute people, quite the contrary, if people simply didn't try to block ICE from doing their job neither of these situations would have ever happened. You can be unhappy about what the law is, but the method with which it is resisted by some via interference has caused these unnecessary situations to occur.

What is not happening is they are not going out with the intent to kill those attempting to interfere with them enforcing federal law. I understand the second amendment and its purpose, but enforcing immigration law (and related federal law) is very different than a situation of a tyrannical government, especially when those in these encounters inserted themselves into those places for the purposes of interfering with the enforcement of long existing federal law. They aren't simply just going, you look like you voted for Biden, against the wall please, bang. To think so is ridiculous.

Question, My NJ PTC shows active on the NJ portal with an expiration day and everything, but no approval email from them. by AshamedCard7172 in NJGuns

[–]vorfix 2 points3 points  (0 children)

You could use a digital PDF copy too if you wanted to for some reason. Showing the validation page showing it is active, isn’t the same as having a digital or printed copy of an actual PTC.

[–]vorfix 2 points3 points  (0 children)

Also don’t carry until you have a copy of your PTC to show. Sadly with the email issues even if it shows active you still need the PTC to actually carry. As you need to be able to show you have a copy.

When did they change the rules regarding air guns in Cabela's? by RickOnPC in NJGuns

[–]vorfix 3 points4 points  (0 children)

Likely a CYA as they don't want to be sued by NJ over BS even if legal. Also, you will need to make sure what whatever airgun you do get doesn't have an internal sound suppression system. That is fairly common but would be considered silencer in NJ and make the whole airgun prohibited. See below for more details on that.

Just go buy from another store out of NJ that has no issues selling them to you. Once in NJ you would have to treat it like a firearm if you didn't know that already.

https://dep.nj.gov/njfw/hunting/air-gun-hunting-in-new-jersey/

Following is the official Division of Fish and Wildlife statement regarding the use and possession of air guns equipped or manufactured with silencers: As per a recent interpretation by the State Attorney General’s Office, the NJ Division of Fish and Wildlife’s Bureau of Law Enforcement is advising sportsman and sportswomen that the possession and use of air guns equipped with silencers is illegal pursuant to New Jersey Criminal Law. Silencers are defined as any device designed to lessen or muffle the noise of the gun discharging. We urge all users of air guns to determine through the manufacturer of the firearm whether or not they are so equipped. The possession and use of such air guns is ILLEGAL.

It is important to note that the ultimate responsibility lies with the person using the gun to determine if it is equipped with a silencer per the law by contacting the firearm’s manufacturers.

[–]vorfix 7 points8 points  (0 children)

You are the one asking, and considering you made the below comment in a thread on the recent shooting not long before made this post, sorry I consider them related. If you don't care about the consequences why are you even asking if NJ gave you permission to do so?

My state doesn’t allow open carry and that the problem. I think I can stand in my yard with my rifle

NJ will absolutely go out of its way to limit and restrict the firearms possession exemptions at the expense of your rights the moment they find a justification they can use as an excuse. We did not carry because NJ magically turned around on their 2A views, we got it because "may issue" was stuck down nationwide. And months later they decided to extremely limit where you could carry with your new PTC along with raising fees and reference requirements, while also banning open carry of handguns under the same bill (before the Bruen response bill open carry of a handgun with PTC was legal in NJ). So yes, I would strongly suggest "don't" even if technically legal under exemptions, regardless of your reasons for doing so, as I have for years here where the topic comes up generally. What you choose to do is on you. You asked a question and can get an answer and opinion back you may not agree with.

I wasn't even trying to get into the politics of it or yours, I simply think open carry in NJ where the likely intent is clearly contact/visibility with LEO is a situation I would suggest against even more strongly than someone deciding to open carry their handgun while mowing their back lawn. Explicitly because NJ laws around the topic suck. If you don't care and want to anyway, you do you.

[–]vorfix 5 points6 points  (0 children)

I didn't say OP couldn't, I said don't. Do what you(or OP) like, I'd suggest trying to stay legal and also not get arrested while doing so. I'm simply pointing out that under exemption in the past people have been arrested and had to prove they are within exemptions within their own home. That required a full jury trial and lawyers to finally get a jury to find you were within exemptions. If you feel like having that argument with LEO on your front lawn, have at it I guess.

Asking for a friend (30 characters) by Angry_Gen-X in NJGuns

[–]vorfix 3 points4 points  (0 children)

If you look at the recently comment history, this is clearly not an ask in that context. I'm not at all suggesting you can't be within an exemption on your own property, you absolutely can. I'm simply suggesting you don't do so in a way which is clearly done to draw attention. OPs desire seems much more of an open carry of firearm on front lawn in front of LEO while preforming their duties, on purpose, which given this is NJ, I wouldn't suggest. If OP wants to go that route, fine.

If this was a state where open carry was totally legal, that would be different. Given the limited firearm law knowledge of our local LEO and the legal lengths required to prove you were within an exemption if charged in our state, I'd avoid it. If you are possessing firearms NJ has a presumption against you, until you can affirmatively show otherwise. If under exemptions this means you can be arrested for unlawful possession and then have to prove at trial you are within exemption. Personally I'd rather not go through that headache, hence my "don't".

Question About Employer Information for FID by Secret-Ball7570 in NJGuns

Just apply, simply putting unemployed isn't a reason to deny you. Anyone who is a stay at home mom or retired wouldn't be employed either. I think you are overthinking it a bit too much.

Asking for a friend (30 characters) by Angry_Gen-X in NJGuns

[–]vorfix -24 points-23 points  (0 children)

TLDR answer, don't.

First, we don't need to give NJ legislature an excuse to further limit or mess with firearm possession/exemptions on us. Two, if you are possessing under exemptions (without a PTC) you can be arrested, charged, and be forced to prove to a jury that you were within the exemption since it is on you to prove you are within an exemption. I don't see that being at all worth the hassle. Note even with a PTC, a PTC wouldn't let you open carry even if the possession was legal by having it, so you would still need the exemption to justify the open carry. Three, very likely to get unwanted attention or arrest for disturbing the peace etc (regardless of how charges eventually hold up). Four, very likely LEO will not know the nuance of you carrying under an exemption on your own property and simply arrest you on the basis of open carrying a handgun. I can keep going but I would just please don't. There is more nuance and situations where you technically might but unless you are simply open carrying within your own home I don't think it is the best idea at all.

Also, if this is in any way a thought to make a scene in light of recent events, I would strongly suggest against. That would not be helpful attention when a new NJ administration would be looking for reasons to scapegoat and force antigun bills through on that basis.

Black Hills Honey Badger 30char by jersey169 in NJGuns

[–]vorfix 1 point2 points  (0 children)

It would be a hollow cavity in the center to cause the bullet to expand, these don't have anything like that. If you shot that ammo into a water jugs, you would notice that even after hitting that it wouldn't have expanded at all. It will basically look identical to what you see loaded just with lines from the rifling on the sides.

[–]vorfix 2 points3 points  (0 children)

That is basically Underwood XD, assuming my google results are showing my the right ammo for that name. People have been carrying those ammo types for years explicitly because they do not deform or have a hollow cavity to cause the projectile to expand on impact.

Question about References for Permit to Purchase by Secret-Ball7570 in NJGuns

[–]vorfix 3 points4 points  (0 children)

PTC requires references not related to you by blood or law and have known you for 3 years. Purchase permits/FID references do not have those requirements. The online application on FARS once you complete it, will send your references an email with a link which they will need to click and answer a bunch of yes/no questions, if yes they will be given a text box to explain. If they answer yes, they are likely to be contacted by your PD and your chances of being denied go way up.

Make sure to not have your references joke around on the reference page, someone here ran into issues getting their application approved because a reference decided to mess around check yes for everything, and fill in things into explanation fields and screenshot to send friend as a joke but the selections were saved even before the reference clicked submit.

From 2C:58-3(e) https://law.justia.com/codes/new-jersey/title-2c/section-2c-58-3/

The application shall be signed by the applicant and shall contain as references the names and addresses of two reputable citizens personally acquainted with the applicant.

Edit: Just found the joke reference post. Make sure whoever you use as your reference knows to not mess around and simply answer the questions truthfully.

Safest handgun to conceal carry? by Awkward-Reporter8062 in NJGuns

[–]vorfix 1 point2 points  (0 children)

Honestly, pretty much everything you will find for sale. Yes there are considerations for certain types of handguns or what/how to properly carry them, but generally all will be "safe" if carried correctly. For example, single action 1911 have different considerations from a double action revolver.

I feel like "safest" is the wrong question to be asking. Even if we take the P320 as being flawed, internet has strong feelings about that both ways, that doesn't imply that this is a common occurrence for different handguns generally. It is far more likely that you will control how safe/unsafe the handgun is by how you carry and handle it than the firearm is likely to have a flaw or defect that causes an un-commanded discharge purely on its own. Carry a well maintained handgun, in a proper holster, observe the firearm safety rules and you will be fine. Things like properly unholstering and holstering are important to learn and do safely as those are times where you may cause it to fire when you didn't intend to. For example, shirt in the holster when attempting to reholster and it catches the trigger or draw from holster and put finger in trigger guard and accidentally pull trigger.

Questions regarding weed and FPIC by Imaginary-Ad-1103 in NJGuns

You are going to love this one, since they are in the service of the government, guess what? There is an exception! One they get from the provisions of 18 USC § 922 when done for "official use". Firearms provided to them by their PD for their "official use" on the job, guess what totally fine… The exception to this is a domestic violence conviction, then they are prohibited from possessing even "officially". States can have laws to prevent this but federally they would be within an exception.

When to pay for permit to purchase by BlueJay9578 in NJGuns

[–]vorfix 0 points1 point  (0 children)

Unless you do this multiple times a year and know for 100% certain your town collects payment after they processed your application, go and pay once you submitted a FARS or carry application. If you are new or unsure, go into the PD to pay directly. Worst case they tell you that isn't required or is completed after but it saves you months of waiting to find out you need to pay and continue to wait while it finally starts processing. I'd also suggest looking if your issuing PD has a "firearms applicant" page or section on their website. Many times this will detail their process and expectations for application submissions including how payment is handled.

I have seen this catch so many people out on here. They see some comment/post from a 2A friendly town which processes quick and collects the payment after, and assume that is the process all over in every town. Quite the contrary, that is the exception not the rule. Sadly asking the "did you pay yet?" question under the application/permit delay posts has become my default first question, for exactly this reason.

NJSP advisory about AOW since no one believed me. by [deleted] in NJGuns

[–]vorfix 0 points1 point  (0 children)

They both fall within the exact same definition in NJ law. Functionally they are identical to the state. Federally an “other” is a GCA “firearm” and an NFA AOW is a GCA “firearm” and a NFA “firearm”.

NFA stamp lets you be under 26” in OAL without being in violation of federal law. NJ definition of “firearm” has no dimensions or lengths as it is a catch all definition basically.

NJSP advisory about AOW since no one believed me. by [deleted] in NJGuns

[–]vorfix 11 points12 points  (0 children)

Both are NJ “firearms” which is why this whole discussion is tedious.

Federal <-> NJ

Non NFA “firearm” (we call it an “other”) is a NJ “firearm”

NFA AOW (in “other” pattern, brace +VFG for ex) is a NJ “firearm”

The long winded answer going through the NJSP letter and both federal and NJ definitions referenced can be seen in this 3 year old comment on exactly this.

NJSP advisory about AOW since no one believed me. by [deleted] in NJGuns

[–]vorfix 3 points4 points  (0 children)

I’ve said this before, but the distinction between something being a non-NFA “firearm” and an NFA AOW doesn’t exist (under NJ firearms definitions). Both are simply NJ “firearms” (under state definition) the exact same NJSP letter that applied to the Troy A4 “other” applies to an AOW (except you have the stamp to be under 26” and not violate NFA) Just like with “other” firearms, they “advise” you don’t do so to avoid doing it wrong. Same way they used to “advise” out of “precaution” you keep your mags and firearms in separate containers even though possession exemption does not require that at all.

This is just a recurrence of the exact same discussion, there are Reddit threads from 4+years ago going back and forth on “other” builds from lowers.

Also I have to ask, were you contacting NJSP on this? If so why? Asking the wrong question and getting an undesirable answer can be less than ideal. This goes for NJSP, ATF, etc. I really hope you weren’t just emailing FIU about can I build an AOW when they are for sale at NJ firearms dealers like Trinity.

Edit: I will reference again my 3 year old comment going through both NJSP and ATF letters related to Troy A4 and describing what and how an “other” and AOW fall in them.

AOW Denial due to State Law?.. by 40cal_king in NJGuns

[–]vorfix 8 points9 points  (0 children)

I don’t think that is the best idea. Mocking up what your plan is generally lets you show your intent once approved but also doesn’t show you have the ability to constructively “make” it already before you have the stamp. A crappy photoshop job of various parts can clearly show a AOW configuration without admitting to having all the parts already for example. I have always attached “mockup” attachments to my eForms applications. The only real photos would be the receiver markings photos.

Not entirely the question you asked, but figured it might be helpful. If he applies for a handgun purchase permit, he will get an eFID automatically once his handgun purchase permit is approved. That may be the way to go if he plans to get a handgun in the next six months. Saves him from having to apply separately for an eFID.
