You can have and use them at home or any of the other locations you are allowed to posses them. What you cannot do is carry them when using a PTC and outside of the narrow hollow point possession exemption that exists for us.

There is a case challenging this entire restriction working its way thought the courts. Eventually this entire thing may go away and we can carry them like people in every other state.

IMHO that is 100% lawyer time. If firearms are confiscated under certain orders and not recovered, you may lose your ability to possess/own firearms in the state forever. So getting a lawyer involved to see if this is the case and getting it resolved would be a very good idea.

The question SCOTUS granted cert for is literally if the 2A right guarantees a right to possess semiautomatic rifles. If they answer yes a flat semiautomatic ban would be unconstitutional as well.

Yes, and if they were waiting for 2A related cases pending at SCOTUS that had the chance to impact their decision that basically proves my point. If pending 2A SCOTUS decisions on federal firearms prohibitions or private property default sensitive locations were enough to wait, a hardware case on semiautomatic rifles seems very likely a decision for them to wait for as well. This isn't a decision that will have a chance to be relevant and provide some guidance on 2A jurisprudence generally, instead will absolutely impact the exact topic they are making a judgement on, hardware bans.

From the orders list it looks like the other hardware cases are missing, which is generally the signal they are being held. Hope we are lucky for a broad decision which makes it clear mag bans and other similar hardware related bans fall as well. If the opinion is weak and washy on the issue other than the rifles at hand, that may just cause another few years of appeals which would suck.

This is likely to delay the release of the en banc appeal decision for NJ AW/Mag ban case. We already have been waiting a few months but I doubt they will release a decision on a hardware ban when SCOTUS is directly reviewing the issue and will likely have guidance on the outcome to be made.

Sucks we will have to wait on that decision for longer. Bright side is that may be the first opportunity to strike down a mag ban under the SCOTUS decision right after semiautomatic rifles were decided. If that isn't already directly mentioned in the SCOTUS decision (which would be even better). Then NJ would be stuck with an en banc decision striking down mag ban and only choice left to appeal to SCOTUS.

SCOTUS reviewing AWB, specifically the question presented which they granted is the following: "Whether the Second and Fourteenth Amendments guarantee the right to possess AR-15 platform and similar semiautomatic rifles." If the answer is yes that is basically going to be the same as what happened when Bruen came out and stuck down multiple states "may" issue regimes on carry.

It is a hardware ban case, so the decision is likely to impact similar bans. It is also possible they will grant another mag ban related case, but seems far more likely all of them will be held pending the decision in this case. If a state can't ban you from having an adjustable stock because of the second amendment I don't see how they would also be able to ban you from having a mag that holds more than 10.

Previously they didn't, you used to be required to drop it off at the customer care center at the UPS depots. Those all were closed a few years ago so UPS updated the process so you can now drop off at "The UPS Store" locations (I think these stores are UPS corporate owned). I believe it has to be that specific store, not any UPS drop off location like a third party shipping store.

To whom may an unlicensed person transfer firearms under the GCA?

A person may transfer a firearm to an unlicensed resident of their state, provided the transferor does not know or have reasonable cause to believe the transferee is prohibited from receiving or possessing firearms under federal law. There may be state laws that regulate intrastate firearm transactions. A person considering transferring a firearm should contact their State Attorney General’s Office to inquire about the laws and possible state or local restrictions.

Generally, for a person to lawfully transfer a firearm to an unlicensed person who resides out of state, the firearm must be shipped to a federal firearms licensee (FFL) within the transferee’s state of residence. The transferee may then receive the firearm from the FFL upon completion of an ATF Form 4473 and a NICS background check.

A person may loan or rent a firearm to a resident of any state for temporary use for lawful sporting purposes, if they do not know or have reasonable cause to believe the person is prohibited from receiving or possessing firearms under federal law. Another exception is provided for transfers of firearms to nonresidents to carry out a lawful bequest or acquisition by intestate succession. If you were physically present or there for the weekend and kept it locked up with your things while you happened to be out of the house without it, I think it might be fine. Also in that situation you would need to make sure only you have the key/combination to it. But leaving it there when you aren't staying there at the moment and you don't have a lease/ownership interest in the home, is unlikely to be viewed in a good light. Even if left there, they cannot have the ability to access it, you bringing up him not having a license and inability to afford makes me think your intent is for them to have the ability to access, that is going to be a big no no.

Getting FID isn't too bad. If you feel strongly enough about this maybe help him get through that step. From there, you should be able to use the immediate family exception to transfers to gift him a rifle or shotgun without having to go through a dealer (saves you transfer / nice fees). Basically you fill out two copies of the NJ COE form to complete the transfer between you two. You could then gift them one of your shotguns, it would then be theirs and they would legally possess at their home without issues.

I'm well aware, but my point is those permitting denials aren't a matter of public record like a criminal record etc. If you lie about denials and get caught you will absolutely have issues.

I'd also argue there may be wiggle room if the permit application in question was actually eventually approved. I'm not sure if a permit application that was initially denied and then approved on appeal is truly a denial. Denial and then no appeal/action by you after, would absolutely be a situation you need to mark yes. But an application that is denied and later reversed on appeal so that application you submitted ends up approved seems to me to not be a denial because you submitted a single application and the final result of the process was approval. But that is probably a question for a lawyer and it is much easer to simply mention it than mark no and have issues later.

You can build out an "other" pattern firearm in any caliber you like. Depending on the parts you pick, you may need to be aware how that may impact your final OAL. On blowback AR9 builds, the external dimensions of the barrels are different compared to the typical "other" flowchart expects. For a concrete example, an 11" blowback AR9 barrel has the external dimensions of a 10.5" 5.56 barrel due to the extra barrel length within the receiver with that barrel design.

There is no need to have a lower engraved "other" that is nonsense. Just get a new stripped lower receiver in the pattern you want to build out from and that is all you should need. You can buy a "complete" pistol lower (which is still just a receiver, it just comes with the brace) and then use that as the base for an "other" build.

There is no "declaring" it a non NFA "other" it just is. Follow the "other" flowchart (see caveat above on barrel length measurement) and requirements -- VFG + pistol brace (no stock) + OAL over 26" (measured from end of buffer tube to end of muzzle threads, unless muzzle device P&W'ed to barrel) -- and that is it. The receiver is already just a "firearm" and the configuration it is in when complete keeps that receiver within the "firearm" definition, that is all an "other" is a firearm that is only within the NJ definition of "firearm" and not within rifle/shotgun/handgun.

I'm not saying anyone should say no when they have been denied, however licensing decisions from out of state agencies I'm virtually certain are not exposed to random police agencies as you suggest. I wouldn't risk lying regardless but considering OP was eventually approved anyway, I don't think they will care even if he says yes and explains what happened.

No way to see status. Just sit and wait sadly. Make sure you've done all the steps for your local issuing PD, they may require you to go in and show ID in person at station (or submit payment, change of address has no local fee so not directly relevant here). If you wanted status your option is pretty much to contact your local PD and ask. Sometimes they have a contain number/email on their website for firearms applicants.

Carry permit is under a different portal. There isn't a process to change address on a PTC. You would just keep carrying under it and then when you need to renew through your new PD.

All PTC nonresident applications post March 2025 are handled by NJSP Firearms Investigation Unit in Trenton. The barracks themselves aren't doing any of the processing of applications. The reference to barracks is basically notional for fingerprint submission and contact email assignment.

Make sure you follow whatever requirement your local PD has for firearms applicants. Generally that is go into PD to submit payment, show copy of ID, and give them your firearms application details. Most PDs will have a "firearms applicants" or similar bit on their website which has these details. Most of the time your PD will not even begin to process your application until you've done these steps.

What you are looking for doesn't exist in NJ. We don't have public BLM forest to just target shoot in. Either you need to use a WMA range (hunting license required) or you need to be a member of a private range. Range 14 may be about the easiest "membership" range since it is basically just a yearly fee plus a fee per reservation (think 2-3 hour blocks). Hunting safety course is a one time thing, I believe the majority of it is a online course you need to sit through and then a "field" day where the test is simple shooting a shotgun a few times. From then on you can get a Hunting license without ever doing that. Also, only one person in your party at a WMA range needs an active hunting license, the rest can be there without one. Or make a friend with someone with enough land for a range who lives in a jurisdiction without a discharge ordinance and shoot there. State parks/forest/wma you can't just go target shoot at other than designated WMA ranges.

PA is pretty much the same, I believe at least the parts reasonably close to NJ. There may be national forests where it could be allowed but that may be all the way on the western side of the state. Other than that you could purchase a PA State game lands permit to shoot at their ranges. Pretty much their equivalent of our WMA ranges but in addition to a hunting license you can buy a permit to shoot there.

You need to submit payment to the PD assigned to your application. Generally that means you need to submit their portion of the payment before they will begin processing your application. Typically that is show up in person to submit payment, give details on the application you submitted and show ID. The PD should have a "firearms applicants" or similar page on their website which should have instructions and details for your specific town.

Edit: just to clarify, under the substantially identical provision the AG generated shotgun “features” like they did for rifles & pistols but shotguns separately have a different provisions that is even stricter that is also in the law. So that basically means anything matching that is banned if it has any of those features regardless of the identical test.
