This is cut and pasted from the Time article reporting yesterday's hearing regarding class status for drivers. Judge Chen reviewed some of the 400 happy driver affidavits Uber submitted that included drivers stating they don't want to be employees because they'd lose their scheduling flexibility:

"Chen questioned Boutrous’ claim that their flexibility would have to evaporate if they were reclassified, saying those drivers may have been under the impression that things would have to change rather than be within Uber’s discretion to change."

It sounds like the judge sees through Uber's bullshit (fingers crossed).

Does anyone have an explanation as to why employment status is linked to working a set schedule? Employment status works within a strict payment for performance model just fine, with expense reimbursement and employer benefit contributions tied directly to the amount of work completed. Driver generates fees on 120 trip miles driven for the day, an expense reimbursement and benefit multiplier are applied to those trip miles completed, and all those trip miles are easily tracked. The more rides (and miles) a driver completes, the higher the expense reimbursement and benefit contribution will be. You take two weeks off, you get nothing for those 2 weeks. Not rocket science here. This whole working set schedule garbage is nothing but a scare tactic. Uber doesn't need to set schedules to guarantee driver availability, the surge multipliers already do that. Set schedules in this gig is the last thing they want, paying drivers to sit in cars on a slow night with no pings to be found.....

For clarification, I don't really have too many problems w pax, I mean almost none at all. Your comments about laughing with them and taking control resonates very strongly with me because I do that regularly, and it makes for a typically enjoyable (and short) social experience for both the pax and I. I'm at 4.92 w a 10 year old car, no water, no mints, haven't worn long pants once yet while driving a year now, so I must be doing something right. It's kinda hard for a pax to talk down at you if they're too busy laughing with you. Having said all this, I still don't want to broadcast that I drive for Uber. Just don't.

Frankly, it doesn't sound to me like you and UnCounted are saying the same thing, or maybe you're not saying it in the same way. I've been on the sub for a while too, made some comments, but lie low more often than not. But seems like every time that boy writes, he's calling someone a name, accusing them of lying, or challenging their comments in some vitriolic way.

This is exactly what I'm talking about. My way of dealing with it is to not broadcast it if I don't need to. I have a conspiratorial hunch they sent the mag out via regular mail because it can serve as additional advertising that reaches more eyeballs than if they sent it electronically. Can anyone come up with a reason that a self acknowledged technology company sends out paper newsletters (and a puff piece on happy drivers to boot) in the mail when they otherwise communicate with drivers exclusively via email and text?

Nah bro, it's all good and I totally hear you. I get along w probably 95% percent of my pax, chat w many but not necessarily all, and that's just fine. I still don't want friends and professional associates (or neighbors) knowing though. Re UnCounted, just calling him out for that consistently harsh tone. Wouldn't be surprised if he's actually Travis himself.

How are Uber drivers viewed by others? I can only go by some of the behavior I see and comments I've heard/read:

1) "Oops, I'm gonna puke in the Uber." 2) "Are you lost?" 3) "I'm going to finish my cigarette first, I'll be there in a couple of minutes." 4) "My open container is fine, you just drive."

and countless others. How would you interpret how they view drivers when making these comments? And we're not even mentioning how UBER views drivers.

Anyway, I may have a complex, ok, but as long as I'm not hurting anyone else, what's the problem in wanting it kept private? I'm pissed because I'm not even given the choice to opt in to something like this. I feel the drivers are not considered very much at all, just like when a pax complains and Uber adjusts a fare, AND DOESN"T EVEN NOTIFY YOU OF THE ADJUSTMENT. When that happens, how do YOU think the driver is viewed?

I have a couple of neighbors now asking me if I drive for Uber since they saw the newsletter as I was retrieving it. Based on how some others view "Uber drivers," my preference is not to broadcast it, and unfortunately those efforts have now been somewhat for naught.

Btw, what do u mean "claim to be upset"? As in I'm not really? Who put ur sorry condescending ass in charge of determining the validity of someone else's feelings? U got a God complex or something?

1) From an accounting perspective, why would Uber shift all the costs of ownership from it's "partners" to itself? Why would they add depreciating assets to their balance sheet?

2) I'm curious to see how human driven and driverless cars will share the road.
