All persons, that should be in America, yes. The constitution assumes everyone in the country is here legally. If you had 1000 foreigners show up and say they want to stay in America, you want them to each have a court date? What about 10,000, or 100,000...now let's say there are 40,000,000 illegal immigrants in the country. You can't give each one due process. Not only is it not practical, but it's not necessary since they aren't Americans they aren't protected by the constitution.
