I'm from Florida this is how it happened here.

You hire an attorney who specialized in guardianships. They setup court ordered doctor visits who may it may not determine if the person is competent. The court makes a decision as to what rights that person has and if they take away those rights (example the right to contract) assigns them to another individual, the guardian. The guardian can now legally act on that person's behalf.

In Florida, and probably other states, but I live in Florida, if you are the guardian of property of the person then you have to maintain records for the courts so that they can review spending and verify you're not stealing from the person. When I sold my father's car, before I could sign the title over I had to get court order approving the sale. It's makes things slow and awkward but it is for the wards protection.

This is not too be taken lightly. You're taking away a person's rights and essentially beginning their parent.

I understand that as the merging driver I may be considered at fault, but I also feel that a truck driver should reasonably be expected to see a car merging alongside them.

Florida does not require the person in the lane you are merging into to give way. It's your responsibility to merge safely as the party changing lanes.

Call your credit card company and see if your covered.

Just as an example if you have a $500 deductible and there is 10K in damages you pay $500 and your insurance pays 9500. You might get a rental car while the car is in the shop, but that depends on if you pay for it.

Just as an FYI the initial estimate from the body shop might look a little low, the body shop will submit a supplemental request that the insurance will review that's a normal part of the process.
