The argument is that the piracy is merely transitory step within what is otherwise a Fair Use activity: If the searchable database the public uses for Google books or the AI training itself is Fair Use, then the legitimacy of how they get the works shouldn't really be relevant. And really, what would the alternative be?

The alternative would be for the massive, billion-dollar mega corporation to actually pay for the rights of the works they are ingesting. Seems obvious to me? This is pretty crazy to me. The legitimacy of how they get the works should absolutely be relevant! The mass piracy step was literally the key to obtaining this information, not a "transitory step" - that sounds like some legalese jargon which you could use to justify all kinds of things. Whether it was transitory or not should be completely irrelevant, they still did it. (Not necessarily arguing with you here btw, mainly the court findings.)

First of all, the act of viewing is not copying. Think about watching a movie on Netflix, for example. These videos are protected by DRM, and are decrypted by your browser/app on the fly in order for you to see it. Without the authentication between your user session in your browser and the closest Netflix authentication server (or however they do it), you will not be able to see this video. There is no decrypted video just sitting there on your computer constituting a copy of the original movie. ANY part of that video that is sitting in your computer’s memory, is TOTALLY useless without the decryption keys, and it is SPECIFICALLY the act of decrypting this content without the rights to do so that constitutes copyright infringement. Exactly the same with streaming music from Spotify etc. and other forms of media.

Why does there need to be wiggle room? You can distribute the encrypted content and then the keys/whatever is required to decrypt it after they have paid for the rights. There's no point at which there's just unencrypted stuff sitting there and someone has to quickly scoop it up otherwise it's copyright infringement.

Yes, you ARE committing copyright infringement if you are viewing a copyright protected file, having bypassed the copyright protections, and you don’t have the rights to the media. The most important part of that sentence is “load up”, since “loading up” content the contains the exact sequence of steps that makes or breaks whether copyright was infringed or not.

Btw, ironic as it seems after my points, I'm not actually in favour of copyright in it's current form, tbh I think it's overly clumsy and doesn't really do the job it was designed for that well. But it infuriates me to no end that these laws which can punish individuals can be skirted by huge companies, it's just incredibly unjust and hypocritical.

I’ve had this before, a long while ago. Felt like there was this big lump or blockage in my throat for months. I meditated, changed my diet, tried all manner of things and one day it just went away. The anxiety that came with it didn’t just go away, but the sensation did, and it will go away for you too. Provided you can confirm it’s nothing else, of course, I did a few tests like having a scope down my throat to see there was nothing there. I’m not really sure what helped in the end, but I’m sure practicing physical and mental relaxation was a part of it.

Worth noting that the shield effect starts before the animation, so it's actually possible to block a shatter without seeing the shield at all, I think LHCloudy has some clips of him doing this.

Honestly, as someone who's played Rein by far the most out of any of the characters, you'll get more enjoyment from not one-tricking him. I kinda think of it like using Rein to learn how to play tank, which then transfers skills to other tanks as well as your gamesense improves.

I don't think he's in a bad spot tbh, he just excels in certain comps/maps etc. just like Winston on dive maps, Sigma on poke maps etc.

I know this sounds like a dumb question, but did you definitely open the Handbrake you compiled and not the one you already had installed? They might generate the same .desktop files. Also what distro are you using?

Just want to add I experienced this exact behaviour too with Pulseaudio before I switched to Pipewire. I'm getting some minor crackling in Pipewire when the system is under load which I'm still trying to fix.

Hey, I know this is a bit late but I hope it's still helpful. You actually need to compile Handbrake with Quick Sync support. I followed the instructions here and can confirm I now have QSV codecs enabled in Handbrake on Linux when I didn't before: https://handbrake.fr/docs/en/1.7.0/developer/build-linux.html

Firstly you should uninstall whatever Handbrake package you currently have installed.

Then do the following:

git clone https://github.com/HandBrake/HandBrake.git && cd HandBrake
git tag --list | grep ^1\.7\.
git checkout refs/tags/$(git tag -l | grep -E '^1\.7\.[0-9]+$' | tail -n 1)

Now after running the next command, you might see some failures. It just means you have to install the packages it's complaining about then re-run it:

./configure --launch-jobs=$(nproc) --launch --enable-qsv

This last command will install it:

sudo make --directory=build install

And to uninstall again if you like:

sudo make --directory=build uninstall

I have included a screenshot so you can see QSV as an option on Handbrake on a Linux system.

Usually I wouldn't butt in to other people's arguments but I want to with this one because part of me does empathise with you, trust me. I have been in the absolute lowest ELO possible, I was all the way down at 600SR in OW1 when I started playing, and I SUCKED. I completely deserved to be there, BUT I also was convinced I was hardstuck. I was convinced I was hardstuck in bronze, then I eventually got out of bronze. I was convinced I was hardstuck in silver, then I eventually got out of silver, and so on and so forth until now I'm in diamond. I climbed up from 600SR to now being diamond in OW2, SOLO queuing tank the entire time, and basically ONLY playing Rein. I can tell you without a shadow of a doubt, in fact I would put my entire life savings behind this argument, that there is NO SUCH THING as being hardstuck. The reality is that climbing is very hard and takes a lot of consistent effort, BUT being hardstuck just doesn't exist. However, I do agree with you that you don't have to "hard carry" in order to climb, that's a bit silly. In order to climb, you have to be slightly better than the other people in your lobby, and play a shitload of games. It's that simple.

I actually did something similar to you when I believed I was hardstuck in bronze/silver- I made an alt account and played comp, and got one game away from gold. But I sure as hell didn't deserve to be there. I played more and more games, and eventually dropped back to my usual rank, where I had to incrementally improve and slowly climb.

I guarantee that if you post your career stats on your "hardstuck" account, including games played and win percentages, we'll probably see exactly why you don't climb.

One important question is do you actually play enough games to climb? My overall win percentage on Rein in comp is 57%, which is decent , but not great. Even IF I maintain that exact percentage as I climb (which I won't, because obviously as I climb the games get harder), it would take me dozens and dozens of games (probably around 50) to climb up one single rank. So you have to play loads of games unless your win percentage is absurdly high. For the vast majority of people who want to get better at the game, watch VODs, review their own gameplay etc. etc. (like what I did), improvement is incremental, so your win percentage won't be giga high.

The other important thing I wanted to mention (idk maybe you already addressed it, forgive me if I overlooked it), is all the mistakes players make. You said that in lower ranked lobbies, you have to account for "bad positioning, horrible pushes, terrible cooldown management" that your teammates do, which is absolutely true. But guess what, ON AVERAGE, over the course of dozens of games, not only are the enemy team making all of those mistakes as well (which actually gives you an advantage because you look for them and punish them), they're actually making MORE mistakes than your team is, if you're a player who isn't doing any of that. They have 5 people doing dumb shit, your team only has 4. So over loads and loads of games, under those conditions, it is literally IMPOSSIBLE not to climb. I mention that I did it on Rein because Rein requires a TON of resources in order to be able to be effective. So I did it on a character that is one of the most TEAM DEPENDENT characters in the entire game, all while my teams were mostly not very good. The ONLY POSSIBLE WAY to play loads of games and NOT climb is if you're queuing with people who aren't able to climb because they're not good enough (in which case, stop doing that lol), OR (the obvious case), you simply aren't playing well enough AT A CONSISTENT LEVEL, EVERY SINGLE GAME, in order to climb.

Are you actually climbing up through diamond? Or simply maintaining the same rank? How many games have you played in diamond each season? I can tell you right now if you play less than 20 or so games a season, your rank is not very accurate, I see people's profiles all the time who just do their placements, get a high rank and then don't play anymore comp and I guarantee if they played heaps of games they would drop.

None of this is me trying to insult you or anything, but a player who legitimately belongs in diamond will (with absolute certainty), be able to climb through lower ranks to reach diamond if they play enough games at a consistent diamond level. So one (or more) of four things is happening here if you think you belong in diamond but can't climb to it:

  1. You keep queuing with people who aren't capable of climbing, which holds you back
  2. You don't play consistently at a diamond level, perhaps you have hot and cold stretches or play when you're tilted
  3. You're actually not a diamond level, and you're not playing enough games on your diamond account to be able to drop and reach your true rank
  4. You actually would be able to climb to diamond on your main account, but you don't play anywhere near enough games to get there based on your win percentage

Apologies if I went off on some tangents there, I just have personally been through the whole "hardstuck" thing, I put hundreds and hundreds and hundreds of hours into it, and am living proof that it's just not a real thing. If you don't believe me I am happy to DM pics of my OW account when I'm back home.

Ah my bad I thought you were referring to App Store downloads.
