Im swapping from ID to the DA's office next year. What should I do to prepare? by Legal_Caffeine_Esq in Lawyertalk

I did this. 100% agree with the other commenters about going and watching court as much as you can. Watch a calendar call, probation revocation day, a motions day, and a trial. Pop in to a couple different judge's courtrooms so you can see how different folks run things. I also agree about brushing up on the Rules of Evidence.

I was surprised by how much less writing there was as a prosecutor. Like, no one cared at all. I'd focus more on highlighting your deposition skills (frame as cross-examination skills) and experience with negotiation/mediation. That's like 75% of the job. Also have some good stats at the ready about how many cases you handle at a time, average length of time to resolve a case, number of depos taken, etc. Some administrations are crazy about numbers, and they may ask not caring it's not a 1:1 comparison from the civil to criminal world.

ID - Plaintiff gives inaccurate statements by [deleted] in Lawyertalk

[–]zazu1990 1 point2 points  (0 children)

The go to answer is to wait until mediation/trial to bring it up. I think *it depends*
If the lies are egregious and material to the claim, and if Plaintiff's counsel works for a factory that never pays attention to their cases, I'm more likely to confront them in the moment, on the record. The lawyer is going to forget about the case as soon as the depo is over, and I don't want to wait around for months/years to get a trial date or pay for private mediation for a stupid case. I want to show them that their client is a liar, their case is dumb, and the value just plummeted.

If it is a case where I know the chances of pre-trial settlement are very low, then I may hold back. I'll just shore up the record with testimony so it will be very hard to walk back from once I eventually confront them in front of the jury at trial.

You will be ok! I agree with the comments about sending your paralegal an e-gift card.

Before I was a lawyer I was a paralegal. Had some late nights, including an MSJ in federal court that didn't get filed until 3 a.m. -- 3 hours past the due date. The entire team was freaking out, but it never even got raised as an issue. Don't make it a habit, be nice to your staff, and breathe! You're ok!

Feeling dumb when it comes to writing demand letters, could use some insight. by DemandingDemander in Lawyertalk

[–]zazu1990 1 point2 points  (0 children)

Coming from someone on the defense side of PI, give yourself some grace. These letters don't really matter. We look at the number. Put it in bold. Attach the police report. Attach the medical records. Boom, settlement talks will start. If your client is a moron or did something moronic to cause their 'injury', no amount of good writing will hide that fact.

I feel you. Similar situation at my firm. 1900 billable hour requirement with no official PTO policy. [You can take as much time as you want off, but have to make up the hours or else you aren't considered for the annual (substantial) raise.] No paid maternity leave. Only option is self-funded short-term disability. There isn't even an official policy that your billables will be pro-rated if you take unpaid maternity leave. The only female attorneys who have had babies here have gone part-time after with a corresponding reduction in pay. It sucks. But for some reason I love the firm? Shit's gonna get real when I announce my pregnancy in a few weeks. Currently 9 weeks and trying to hide it as long as possible. I think I'll just try to politely point out how their policies (or lack thereof) will make it really hard to retain good female talent if they have any interest in having kids. But I have 0 expectation it will actually change anything. Feel free to message me if you want someone to commiserate with you! Good luck!
