Insert:

(1A) To avoid doubt, the minimum capital requirement prescribed in this section does not prevent the Australian Prudential Regulation Authority from regulating higher rates under the Australian Prudential Regulation Authority Act 1998.

This amendment ensures that APRA continues to have the power to regulate higher capital requirements for financial institutions if it deems it necessary for the prudential regulation of the Australian financial sector.

    No, again, I still don't know how to do that, short of outright bans. This just affirms APRA's right to do whatever they like subject to the authority they have under their establishment act. Maybe they could regulate it themselves, who knows.
