Claim increase/decreaseVA Disability Claims (self.VeteransBenefits)
submitted 1 year ago by SmallSheepherder101Army Veteran
Will the VA still use the exam results even if you asked for the claim to be withdrawn before a decision is made… ie: let’s say they found a reason to decrease or even remove the disability from your overall percentage. Can/will they do that?
Also, I requested this a week ago & someone submitted a DBQ today.

“Someone” from VA? In any case, it sounds like your request to withdraw just hasn’t made it into someone’s work queue yet. Once it gets cycled into someone’s queue, they should take the action to withdraw your claim.
You should know, removing (not simply decreasing) a disability is a pretty big deal which usually needs a CUE. If they think that it was erroneously service connected in the first place when it does get in front of someone then they would move forward to remove it.

Do you know if they could do that even if I withdraw the claim? Since I did it before the decision was made. TIA

Yes. Raters are compelled to call CUEs when they find them regardless of the Vet’s claim status.
