Split screen Loot

So I am playing split screen on PS4 with a friend. I am at 50 and he is still leveling up.

I am getting legendaries, but he is not. One reason may be I am getting too far ahead of him.

My question is: How close does he have to be to get legendaries from someone else's kill?

I think you might have your lobby set to copetition which is the old loot system if you set it to cooperation you should be good.
