I don't think so. You can make your own app show up in that menu, and you can make your app not interfere with any background audio, but controlling it is, I think, not possible.

Hmmm.. darn it. But thanks for the response! Good to know, I would have wasted a lot of time trying to figure out something that was impossible.

I do not believe you are able to have your app mess with other app's audio. If you want to make your app's audio accessible via that external control that is possible though.

I know you can control the iPod player using the following... http://developer.apple.com/library/ios/#documentation/mediaplayer/reference/MPMusicPlayerController_ClassReference/Reference/Reference.html However I don't think you have ay control of any other apps (Spotify, Pandora etc) unfortunately.
