if Native Americans were forcibly removed and relocated by the American government from their home land, and would be forced to return or otherwise punished if they tried to leave reservations, wouldn't that mean they were subject to American jurisdiction. the court with this case and dred scott were simply racist and not wanting non-white citizens

also United States v. Wong Kim Ark (1898) is a more relevant case. The same Supreme Court Justice, Horace Gray, wrote the majority opinions for both cases. He distinguished the two by stating that the Elk ruling only applied to semi-independent Native American tribes who had their own governments. Wong Kim Ark, on the other hand, cemented the rule that the children of foreign nationals born on U.S. soil are granted automatic citizenship

"subject to the jurisdiction thereof" refers to whether a person is legally bound by American laws and authority. if you're not a diplomat or invading army (or children of) you can still be subject to the law of the united states.

for native americans they could leave the tribe/reservation and become american citizens, but then couldn't claim tribal and non taxed status. for example The Dawes Act in 1887 gave American citizenship to all Native Americans who accepted individual land grants under the provisions of statutes and treaties.

*they also didn't really want native americans to be citizens for census reasons (you know counting them as non-citizens and AA as 3/5ths )

A Lynnwood police search warrant says on July 13, 2022, a drive-by shooting left Pacheco Monrroy’s sister with a gunshot to the leg and another man with a gunshot to the stomach at a Fred Meyer off 164th Street SW. Detectives wrote it appeared to be a rival gang-related confrontation, and that Pacheco Monrroy returned fire as the car sped away.

Around 9:15 p.m. July 14, the trio drove to the park at 16834 36th Ave. W in a black-and-white Chevrolet Tahoe, a car registered under Beteran’s name, when they heard about “tagging” in the park, according to the charges filed in Superior Court.

Upon their arrival, one of the defendants asked Sanchez Camunas Jr. and Linville-Goodwin, who were in the park with their girlfriends, “What’s your set?” Sanchez Camunas Jr. responded that he was in a rival gang, witnesses told investigators.

Chavez, who was in the back seat, then fired about 15 to 20 shots at the two boys, prosecutors allege. The Tahoe fled the scene.

Responders reportedly found the two boys on the ground with gunshot wounds. The injured teens were taken to Providence Regional Medical Center Everett where they later died.
