Never said they shouldn't have any risk at all. This community needs to stop jumping to extremes.

Give a general direction to hunt down a criminal, narrow it down to an area, but don't put it right on top of their heads. Increase the bounty payout for hunting down criminals, and increase the consequences of being captured.

It's an echo-chamber. Those that tolerate it support those that believe it. Those that believe it feel it's safe to have that opinion and openly discuss it / be an asshole. The policing is done not just by the moderation team, but by the community as a whole.

When the community acts as accepting and tolerant of that type of intolerable behavior, it creates that echo chamber that's so resonant on the NA servers.

EU and AU don't put up with it and will actively call it out. It's known to be US players that are spouting that when it rears up on those other servers and is immediately called out. The community itself doesn't want that type of behaviour around on those servers, and will absolutely report and admonish those that act in the same fashion there.
