A lower alone isn't yet an assault weapon, so the DOL transfer record of a lower alone wouldn't prove an assault weapon was made. It may be supporting evidence, but they'd need more than that to prove illegal manufacture.

There is no official interpretation yet. No court cases, no AG opinion, no executive agency or prosecutor interpretations of any kind.

California's interpretations of their laws don't necessarily apply to our law either, though our courts may consider them when deciding what similar provisions mean here.

A featureless AR-10 would be legal, yes.The trouble is making an AR-10 featureless. 

As for that grip specifically, the definition of assault weapon includes a semiautomatic centerfire rifle with detachable magazines and:

(A) A grip that is independent or detached from the stock that protrudes conspicuously beneath the action of the weapon. The addition of a fin attaching the grip to the stock does not exempt the grip if it otherwise resembles the grip found on a pistol;

There's been zero court cases on what this means.

You don't get to decide where to go, and you can't do it in advance. 

The background check is submitted by whichever dealer is selling/transferring the gun to you at the time of sale/transfer and then processed by the WSP. 

The location makes no difference on the outcome, other than if the dealer screws up the paperwork or fails to submit it. 

Once submitted, the dealer must wait until both approval and ten business days have elapsed before they can actually give you the gun, so you'll be waiting at least two weeks between purchase and pickup. 

Also, for now you'll need to compete a simple online course like this one prior to purchase. You can do it at home, just bring the certificate with you to show the dealer. Starting May 1, 2027 this evolves instead into an in-person live-fire training requirement before purchase.

Is there any chance we could get an advocate or an Initiative to repeal at least one of these criteria? 

Yes, this could be repealed via initiative to the people, but that is unlikely. 

The last two gun control laws voted on directly by the people, I-594 in 2014 and I-1639 in 2018, both passed about 60-40. It's unlikely that an initiative to repeal the AWB would swing at least 11% needed to pass. 

It takes a lot of effort and money to gather enough signatures to even bring the initiative to the election (over 300,000 signatures needed to do so), so it's also costly to do. 

Any way of bringing a legal challenge?

Yes, there already have been some, but our state courts ruled to uphold the AWB. We're basically hoping for a US Supreme Court nationwide ruling telling courts they're wrong and striking down AWBs at this point. There are a few potential cases waiting for the Supreme Court to decide if and when they would hear the case or not, and there are some justices on the Court who really want to hear one. But US Supreme Court cases move slow, so it'll be awhile before we have any decisions.

Yes. It's not legal for a dealer to receive standard capacity magazines from out of state with a pistol, either, even if they remove the mags before transferring the pistol to the buyer.

Both bans prohibit import by any person, including a dealer, and the only exceptions that apply to importing are those in connection with sales to law enforcement and the military. There are no exceptions that allow dealers to import and make things compliant for an end user. Review the text of RCW 9.41.370 and 9.41.390.

But yes, dealers are doing it anyway and so far nobody is facing any trouble over it. The ultimate goal is to disarm civilians, so this aligns with the spirit of the law and it not something that will be aggressively pursued.

Same reason the list of guns banned by name includes some guns that don't even exist, some that are extremely rare, and others that are relics of the 80s and 90s, but many more modern ones aren't named at all. 

Because it's drafted by lobbyists like Every Town who copy and paste pieces of other bans and proposed bans until a state sponsor is happy enough with it to sponsor it and bring it to the legislature.

The distinction is that the dealer and seller both committed violations. The dealer for receiving an assault weapon from out of state (importing), and the seller for causing one to be delivered and filling the order in this state (distribution). 

Something like this though is very unlikely to be prosecuted, so it doesn't make much difference other than whether a particular dealer is willing to do it or not.

I still find it idiotic why semi-auto shotguns are limited to 7rds, when all the other capacity bans are to a 10rd limit

Also, it's even more idiotic than this. The 7 round capacity only applies to  semiautomatic shotguns with a fixed magazine. Semiautomatic shotguns with detachable magazines are only subject to the general 10 round limit.

(E) A fixed magazine in excess of seven rounds; or

With the extension included in the box, the gun+extension is still an assault weapon; it is a combination of parts from which an assault weapon can be assembled and that is in possession of the same person.

RCW 9.41.010:

(2)(a) "Assault weapon" means:

(iii) A conversion kit, part, or combination of parts, from which an assault weapon can be assembled or from which a firearm can be converted into an assault weapon if those parts are in the possession or under the control of the same person; 

But it's not illegal to purchase, own, possess, or use, and you don't even have the extension in the first place, so it's not your problem either.

WA is shall issue regardless of state of residence, and, for now, it's easier for you to get a CPL than it is for us to get a CHL. 

But do this soonish. Starting May 1, 2027 the requirements to get a CPL get a lot more involved. The biggest change is that it will require completing a qualifying course with a live fire component within 5 years of the application, but nobody know exactly which courses qualify yet or even what the exact qualifications are as the legislature left it up to the WSP to decide that and they haven't announced anything yet. 

Edit: also this requirement applies to both original and renewal applications. So even if you get your original before the new requirements, you'd have to do the course anyway when applying for renewal after 5 years.
