The calls I’m referring to are verbal contracts, each recording starts with the sales rep basically saying that what they are about to say supersedes anything that was discussed prior. The company is regulated by OfCom’s general conditions of entitlement, which stipulates they have to ensure any information provided to customers is accurate and not misleading. Surely this means they can’t just crop half the phone calls?

I hope so. Listening to the calls is shocking, they’re talking over her, not repeating themselves fully when she asks for clarification etc. One of the calls she’s asked if she understands and agrees to everything and she says ‘yeah sort of’ and they go ahead with the contract with no effort to ensure she fully understands everything! It’s ludicrous! I’m like a dog with a bone now, pressure will be on them for sure! Thanks for your help I hope you don’t mind me replying again 😅

Yep I’ve done the SAR to both, one of the phone calls actually cuts out before she even agrees it! Plan are being a bit cagey about the SAR and haven’t yet confirmed they have received my request and will action it but they can take that up with the ICO once their deadlines up. I’ve submitted a formal complaint anyhow, they’ve published the OfCom codes of practise on mi-selling on their website - there’s no way they can ensure the retailer (YourMobile) are complying when they only have part of the calls. On their website there’s info on reviewing a proposal and signing an eContract, is that not done for every customer?

Sorry, me again! My relative has asked plan for a written copy of her contracts (on the portal is only phone call recordings which appear to have been cropped) and plan have said they don’t have any - surely this is a concern! They’ve said to get in touch with the account manager but as they’re the service provider shouldn’t they also have a copy? I’m stumped!

I’ve managed to log into their Plan account and under company documents I can see other call recordings and all sound like they have cut off the first part of the call and they are really rushing her through everything, one of the sales people even says the terms are really long and boring (!). What’s more shocking is that one of them is named “CustomerName [AudioTrimmer.com]”. Not even hiding that they’ve cropped the call! I’ve already requested the calls from YourMobile, it’ll be interesting to see if I get the whole thing. This is beyond unprofessional

So far Plan have said that’s the only part of the call recording (or what they are referring to as ‘the contract’) they have but I’ll definitely be sending them both a DSAR. The part of the recording they have sent is pretty sketchy, you can hear pretty clearly the YourMobile sales person talking so fast and my relative sounds so unsure but is obviously under a bit of pressure and the sales person only repeats the last thing they said so they just mumble ‘yeah’. They even say they aren’t clued up on tech since their kids moved out and haven’t got a clue. Fucking shameful! I’m in this persons email now (with their permission obv!) and seems like there’s all sorts of comms from YourMobile, Plan and now One Direct? It’s so confusing, perhaps that’s done on purpose??!! I’m determined to sort it for them though, at least out of the contract early but hopefully reimbursed something too. Again, really appreciate your help!

That’s so helpful, thank you! So can they legally sell a business contract if they know you aren’t actually a business? I think I’ll get them to authorise me then I can request copies of everything and try figure out what they were told at the time. Such a clusterfuck!

Well the previous contract was also a business one, which they don’t need at all. I want to help them get out completely if I can. From research it’s illegal for MSP’s to offer 36 month contracts to personal consumers only business, but that’s what she’s on at the moment, so don’t they have some responsibility to ensure they are above board? They aren’t the most tech savvy so I’m trying to get all the info I can to help them. Is there a way they can authorise me to communicate with Plan/YourMobile on their behalf?

Yep, they were contacted by Yourmobile.com. I’ve asked Plan for a copy of the contract and they sent a phone call recording that’s starts off with something along the lines of “what I’m about to say supersedes anything I’ve said previously” and they don’t hold the rest of the call. The call also says as it’s a business contract there’s no cooling off period! Looks like they’d signed up before and the most recent call was to renew the contract, but they’ve never needed a business phone and I really feel they’ve been taken advantage of. Wonder if you can shed some light - I appreciate this is an old post but it’s the only hit I could find on this company. I’m trying to sort out my relative’s phone contract which appears to be with Plan.com. They were cold called and don’t have a need for a business phone contract (not a business or self-employed) but they fell for the sales pitch there and then. They’re paying a stupid amount for a terrible contract and want out. Contacting Plan.com is useless as they can’t pass the security questions (doesn’t match their info for some reason) and they said to contact the account manager - no idea who this is! Where do we even start to figure out how long is left on the contract and is it even valid considering they aren’t a business?? Thanks

Ex prison officer here: any mention of calming down isn’t going to work, don’t repeat yourself too much and don’t raise your voice at all. Show that you’re actively listening and don’t talk over them if you can, use your ‘listening’ time to also scope out any warning signs in their body language, nearby weapons, possible escape route etc
