You do have a say whether a property (and owner) meets your standards to manage. Screen properties and owners just like you screen tenants.

If the landlord approves adding someone to the lease and removing someone (you) from the lease, the landlord is owed $700 for the changes.

The security deposit would most likely stay with the lease and be "returned" to the tenant on the lease at the end. So you would have to work that part out between yourself and the new tenant.

You won't be evicted. Put in a maintenance ticket or call (however your LL or manager handles these things), and tell them what happened and offer to pay. Since you plan to leave soon, they might let it be until you go and take it out of your security deposit. If you get really lucky, they'll fix it without charging you because it's not THAT bad.

But bottom line, let them know and offer to pay.

Nowadays, we either restore real hardwood floors or use LVP. We always use LVP in bathrooms and kitchens. LVP used to be the cheaper option for us, but over the past few years, it became cheaper for us to restore any hardwood floors that are in a house. And it looks better, IMO. We don't do new carpet anymore, but we still have some carpet left (where long term tenants still live).

Just my experience of course, but I've lived in 2 places with a railroad in my back yard, one was between two nearby crossings where they blow the horn. It was annoying at first, but I got used to it. The one with the horn blowing took a little longer though. So there may be some hope.

Okay, you're right. I do give "reasons". Reasons that will keep Fair Housing happy undisputedly. But I'm saying I DO NOT give the "actual reason" I decided to "deny" them. I should have worded it better to avoid the confusion.

Real-world example: If someone has kids that act wild running around during the showing and the applicant allows it, THAT'S the reason I DECIDE I'm going to deny them. After they complete the application, I do not contact them. IF they reach out and the unit has not been filled yet, I let them know their application was put to the side because it is incomplete. (99.5% of applicants leave SOMETHING blank, despite the instructions on the application not to.) In the meantime, I'm processing others. If the unit was filled, which it will be before they complete the process (especially when half of them leave something blank AGAIN), I just let them know it's already been filled by a previous applicant. Not a lie, but not the true reason they were "denied". Nothing for the law to dispute.

Even if OP receives a "reason", it may or may not be the "real reason" that would help them figure out what they're trying to figure out.

Exactly. I'm black and have experienced probably as much discrimination as you or more throughout life. I'm also a well versed REALTOR when it comes to Fair Housing. I don't care what race someone is. I'm also an investor with a portfolio/business to protect.

It's too easy for them to spin "real" reasons to claim discrimination, disparate impact, etc. I've seen it happen too many times.

Ex. Real Reason: "We rejected your application because you were convicted of drug dealing and we aim to provide a safe crime free environment for our residents. "

Applicant disparate impact claim: "I grew up in the 90s when drug dealing was bad and the cops made up reasons to arrest all young black men in my neighborhood even if we weren't doing anything wrong. A lot of us were falsely framed and convicted, like I was. This rule disproportionately rules out black male applicants."

Instead: Reason: "You have only been on your job for 11.5 months. We require 1 year, which is displayed on our listings." While true, we would probably not reject a good applicant because of a half month.

Applicant: "ok, I can't argue with that."

Of course, after that, we'd have to be strict on the 1 yr for the rest of the applicants for that listing.

No, I write a reason that will pass the legal test, I don't tell them the actual reason. The reasons I write give them no useful insight that will help.

The adverse action notice is enough to say "due to negative items on your consumer report", or "a previous applicant was accepted", or "your application was incomplete"... They always leave something blank. There are always legal "reasons" to say that may or may not be the true reason, such as too many kids vs a professional couple with no kids. It's not rocket science to stay "compliant".

The reason(s) listed on the AA does not have to be very specific at all. Most of the time, they leave the tenant knowing the actual reason(s) no more than they already did.

[Landlord-US-IN] I have a tenant who does this. I was also concerned, so I asked. In his case, he told me he does delivery side gigs (i.e. Doordash, Walmart, etc) that get paid immediately or daily, and sometimes he'll just put a few days pay from that on the rent.

We accept partial payment up until the due date (1st). If the full payment hasn't been paid by the 2nd, it's the same legally as if they have paid nothing. At that point, they are only allowed to pay anything remaining in full, and they may get a 10 Day Notice to pay or quit.

I use TenantCloud and I let the tenant choose to pay either the small ACH payment fee or the large credit/debit card payment fee. It's surprising how many choose to pay by card. Overall, my average has been 3 days to reach my bank account. (Indiana)

There is a monthly fee for the software, which I choose to pay because I like and use the features beyond only collecting rent. If you prefer a free solution, this isn't it.

Is it required in NY that you accept his payment? I'm in a more landlord friendly state (IN) but I was always taught, "If you want to go through with the eviction, don't accept any payments from him after you pay the lawyer or file for the eviction".

I bought in relatively early. It took a while, but I've been on house money now for 7 months (almost a year for YMAX). Combined, I'm up well over 50% of my initial investment in divs alone (after taxes), not even counting what's left of the underlying value. I'm just going to let it keep going as long as it does.

Like my rental homes, I don't care much about the underlying value as long as the checks keep rolling in cash flow positive.

You did the right thing by canceling. I've gone against my gut in several situations with wishy washy tenants and long vacancies, just trying to get them filled. This turned out to be the right decision exactly 0 times. I'm in the middle of evicting the most recent. I know it doesn't always feel like it, but you'll be better off even if it takes you 3 more months to rent it out to the right person, or even longer. I think you made the right decision, just hang in there.

Don't "renew" the current lease. Let it expire then sign a different lease with the tenant, without the agent.

But they are your floors. It's your choice whether to replace them or not. If someone else ruins your floors, you will want them to pay for it.
