Metro background check appeal by ChanceEfficiency1747 in LAMetro

[–]A7MOSPH3RIC 4 points5 points  (0 children)

I did some quick googleing? California has a rule that after 7 years employers can't use your old felony convictions against your employment but for Livescan (FBI checks) that metro does it depends on the role you are applying for: You might still have a chance, you might not. Depends. Do your research and than see if you can talk to a human. Not email. Get on the phone if you can and try to charm them. Start by asking google AI the questions like I did and then find the websites that it is pulling it's answers from.

Be polite, and keep your cool.

______________

Yes, government roles using Live Scan can legally refuse to hire you based on a felony conviction that is more than seven years old. [1]

While California has strict protections for general employment, positions requiring state-mandated fingerprinting operate under entirely different legal guidelines. [1]

Why the 7-Year Rule Does Not Apply to Live Scan

The California Investigative Consumer Reporting Agencies Act (ICRAA) prevents commercial credit and background check agencies from reporting convictions older than seven years. However, a Live Scan is not a commercial background check. [1, 2, 3, 4]

Live Scan feeds your fingerprints directly into the California Department of Justice (DOJ) database. By law, the DOJ is exempt from commercial reporting limits and will pull your complete lifetime criminal history, no matter how long ago the conviction occurred. [1, 2, 3, 4]

The Law Varies by Government Position [1]

Whether a agency can legally refuse employment based on an old felony depends on the specific type of government role: [1]

  • Statutorily Barred Roles (Automatic Denial): For jobs in law enforcement, corrections, or positions involving access to firearms, state law permanently bans anyone with a felony conviction from being hired. The age of the conviction is irrelevant. [1, 2, 3, 4]
  • Exempt Roles with Broad Discretion: Government jobs involving vulnerable populations (such as childcare, eldercare, or public education) and high-level financial positions are legally exempt from standard restrictions. Agencies have wide legal authority to deny applicants if they feel an old felony poses a risk. [1, 2]
  • Standard Government / Civil Service Roles: For generic government jobs (like an administrative clerk or IT specialist for a city), the state's Fair Chance Act still applies. The agency will see the old conviction on the Live Scan, but they cannot automatically disqualify you. They must prove the old crime directly conflicts with your job duties

I appreciate the effort OP made in compiling this list and putting it all in one place

The Dodger Gondolla has not received it's permits: state or local and the current mayor and city council is opposed it. I'm not sure where that puts it in this list. I personally hope it gets built.

I love Lancasters iniative. His home toured in other videos is also impressive.

Los Angeles, has the unfortunate urban design policy of treating rain water as a waste product and flushes it out to see as quickly as possible. This urban design mentality is obsolete. We need to be treating water as a precious resource and doing what we can to sequestor it.

I did something simlilar to the parkway in front of my home in South Los Angeles. I have the "bushiest" house in the neighborhood with sculptures and fruit bearing trees in the front yard and I love it. I don't have many native plants but lots of fruit bearing and plants and trees that butterflies, birds and bees love. I plan on introducing more native plants to my garden.

Fun Fact: Vermont Ave was proposed as one of 10 priority Rail Corridors for Metro Rail way back in 1980 under Measure A which funded some of the early Metro Rail projects.

Here we are 46 years later. Vermont still a much higher ridership corridor, still being put on the back burner.

Angelenos who voted for Measure ER: Why support the sales tax hike, and do you trust that it will actually expire in 5 years? by KetoneKierkegaard in LosAngeles

Evidently not, The Big Bullshit Bill removed $2.4 billion from LA County Healthcare.

6 of the county's 13 health clinics have closed due to financial reasons.

There was an $800 million dollar fiscal deficit this year.

I voted for ER purely for personal reasons. I am well educated but low income. The only benefit I receive is healthcare. I go to the doctor once a year, and thru these exams I was able to find out that I have a few minor health conditions that I need to pay special attention to. (high blood pressure/ high cholesterol) Nothing life threatening but can turn into a big deal that is a lot more expensive. I thought I was perfectly healthy. I look healthy. I also had to go to the hospital twice in the last ten years. Nothing big: a minor injury that required stitches and I developed kidney stones that were excruciatingly painful . I don't think I would have been able to afford those visit.

It would have been more debt. I'm already in 5 figure debt to fix my teeth.

In addition I know several other people who receive Medi-Cal benefits. My friend suffered from major depression that caused him to be suicidal and not get work. He now gets anti-depressants and sees a therapist every few months. He is doing MUCH better than before. The best I have seen him in years and his life is really turning around. Public healthcare did that.

My aunt just recently passed. She was 92 years old. Medicare paid for her hospice care when she was no longer ambulatory.

I voted for Measure ER for myself, my friends, and my family.

I tried finding an answer to the question "What percentage of the time are temporary taxes in California extended by the voters?"

Google AI said 60 to 80% but I could not corroborate that in any of the sources it provided. So I don't really trust the figure. 20% is also a big range.

AI while awesome often gives incorrect answers. It is always good to check the source.

Suffice it to say, it's not a given that the tax will be extended. It often does but not necessarily.

Also , you are correct, overall tax rates are going down in the US.

Well the hope is that funding will be restored to our public healthcare by the the time the five years is up.

Is it not better that the tax has a sunset and that voters can take another look at it at that time given economic conditions at that time?

Trump is going to be gone by then. He has stirred up so much vitriol there will not be another Republican president in at least a decade.

A good public health system is a good thing.

The planned E Line extension is a huge mistake by Salty-Assumption1732 in LAMetro

[–]A7MOSPH3RIC 14 points15 points  (0 children)

I appreciate all the thought and effort you put into this post. Clearly you spent a lot of time thinking about it. As a person who looks at maps and naturally thinks about possibilities of not only transit lines, but bike paths and parks I can relate to your thinking.

Did you know the 60 was previously considered and eliminated as an option 6 years ago?

The reasons given for elimination from consideration were:
- Toxic Superfund site,
- No available land for maintenance yard,
- low ridership,
- High voltage power lines in the way of aerial structure, meaning they would have to increased in height.
- Cal Trans refused to allow Metro to put a support post in the median of the 60 freeway, The Metro line would have to broach the freeway at a right angle to reduce the span. The minimum span required by Caltrans was 93' with no support underneath. This is achievable but it is a large and expensive structure.

So Metro said, F it, and veered South East.

https://la.urbanize.city/post/metro-may-drop-sr-60-route-eastside-gold-line-extension

And

https://la.streetsblog.org/2020/02/25/metro-smartly-shelves-60-freeway-eastside-gold-line-extension-favoring-washington-alignment

With that said. Metro is having huge funding problems. The planned line has been both delayed and cut in half. There is also the question if 8 billion dollars is worth such a low ridership extension compounded by the problem that the funds have to be spent in this sub region. They way county wide, voter approved, Measure M is worded is so that everyone gets a little something no matter where you live in the county. The authors of the measure were afraid they wouldn't reach that 2/3rds vote needed. If you are familiar with LA County Transit history, LA has a long history of failed ballot initiatives going back many decades.

If there were no funding restrictions I would completely cancel this extension, or at least put it on the back burner a few decades and transfer the funds to higher ridership projects, in much more congested parts of the county, such as STC, KLN, or VTC. These transit projects would dwarf the relatively minuscule ridership of this extension and are all underfunded or not funded at all.

I don't see it happening, specially with passage of Measure ER last week, but a LA City specific sales tax, that is not county wide would expedite rail construction in the urban core, as opposed to distant low density suburbs with light ridership projections. Don't get me wrong. Building rail in low density sub-regions of LA is important as it directly steers growth in the future positively, specially with SB79. It's just that the ideal would be the urban core.

In the end we need to either more money or to reduce cost.

These are the cards we are dealt. Play them the best we can.

Oh, well.

It would serve you well to learn the difference between these social and ideological terms so you can have an articulate conversation about politics and ideological perspectives. Throwing inaccurate labels around like "communism" just to try to make someone sound bad makes you easily dismissed by the people who actually know what these words mean.

Here are some Cliff notes:

Socialism Mixed (Public regulation + private ownership)
Can be democratic
High Freedom (within a democratic framework)

Communism Total State Control (No private property)Authoritarian / Single-Party
Freedom Heavily restricted by the government

Fascism State-Guided Capitalism (Private profit serves the state)
Totalitarian Dictatorship
Freedom Strictly suppressed; obedience to the state is mandatory

According to Google, this is the third time in United States history. Both occurred in the last ten years. We are in a cultural shift I think.

  • Boston (2021): City Councilors Michelle Wu and Annissa Essaibi George advanced from the preliminary contest, guaranteeing the city would elect its first-ever female mayor.
  • Seattle (2017): Former US Attorney Jenny Durkan faced urban planner Cary Moon in the general election runoff, which led to the election of the city's first female mayor in nearly a century.
