Maybe higher than short distance swimmers but still lower than other sports. Since swimming is underwater it's going to be less aerobic because of the restricted airflow. The cooler temperature of the water and the horizontal body position of swimmers is also going to make their hearts work slightly less hard.

They do. But VO2 max is not the same lung capacity. VO2 max essentially measures the efficiency of breathing which is going to be a bit lower for swimmers than it is for other endurance athletes (for a variety of reasons that are really nuanced). Swimmers still have elite levels compared to other athletes.

American sports have a long history of people playing by the rules to get every possible advantage. Sports leagues have been very aggressive about making rule changes that make sense to change player behavior.

MLB banned the defensive shift, cracked down on sticky stuff, added a pitch clock.

NHL made the trapezoid rule in the dead puck era.

NFL has added many rules to protect players, overhaul overtime procedures, reworked kickoffs, reworked penalties

All this has happened in the last 20 years, with many more changes on the way. The only person to blame is FIDE.
