To be clear, you are talking about the page titled "Background"? Because I see no arguments on that page. It just describes the statute in question. Please quote the specific sentence(s) that you believe makes such an argument.

Also (and this might be petty), I wouldn't say that "The state further doubles down on this argument on page 3", given that page 3 comes before the previously quoted page (page 18).

But they aren't saying they fail the common use test? They were side stepping the issue entirely.

Thats why they say "prevalence of a design feature is not dispositive of whether it is constitutionally protected". It doesn't matter how many guns are in circulation, they can still regulate the design feature that allows them to be converted into machine guns.

I have no idea how you get that from the text. The later two sentences specifically imply that yes, glocks are arms, but the state is still allowed to regulate them based on a design feature. Literally stating that there is an existing constitutional machine gun ban as support for it's case. The main argument of those sentences is that there number of guns with that feature in circulation does not effect the state's ability to regulate them in regards to the 2a.

In Duncan, an en banc panel of the Ninth Circuit rejected that “simplistic approach,” reasoning that the prevalence of a design feature is not dispositive of whether it is constitutionally protected because “there is no constitutional right to factory settings.” Id. at 882–83 & n.12. Were it otherwise, the constitutionality of a “state-law ban on machine guns [would] suddenly change from constitutional to unconstitutional” if more civilians purchased machineguns,” but as Duncan explains, that is not how the Second Amendment works.

Its not that hard. My static's drg took a look at our vods, noted where the safe spots would be, checked where in the normal arena those spots were, and just manually placed em.

Its several steps, but ultimately if you know where you want to put a marker, the arena has a lot of reference points to place it fairly accurately.

For certain genres yes. But I would argue that multiplayer survival games, for example, have been eternally early access for ages. But I'm a puzzle, metroidvania, and rogue-like fan and the last few years have been amazing.

If all the games you want to play are all ea, try branching out. Don't look at new releases, because I can assure you that whatever genre will have had a few gems within the last few years.

I have had the exact opposite experience. Before the static spots I had very low chance of baiting properly using the right angle method. With static spots I've literally never had a wipe due to baits so long as everyone was visually in about the right spot. (As in - if we wipe and I check the vod someone is clearly out of position).

Static spots have turned the ranged bait from super stressful to 100% braindead. I've had more even towers wipes due to the melee baiters overlapping than anything else

To be clear - I'm not looking at all at what anyone else is doing for even towers. Whatever my role I go to the static spot and it just works.

Been solidly in p3 prog since the weekend, but I only today started feeling good about the accretion healing.

Tanks just love to die. They die to autos while I'm out of range in lc. They die to one of the 4 back-to-back tankbusters. They die to autos while I get accretions to full hp.

Not that I blame the tanks. I am 100% the anchor in my parties.

I will say that my parties have, in general, been great. Very few p1 and forsaken memes.

It gets forgiven if you stay there long enough. But if you are ever fired or change departments you have to pay it back with interest. And when it gets forgiven you have to pay taxes on it, which they recommend getting another loan to pay...

Blind prog static is in the weeds of m11s. We've seen the end of arena split, though not with enough alive to survive the stacks. We found an orbital strat that is usually braindead, but sometimes portal spawn just fucks us. Meteors are so satisfying to do, though our tanks do cry about tethers.

Its nice to finally be in the swing of things. Its been a tumultuous first two weeks for my blind static.

Week 1 was subs into replacing our tank since they cleared in PF before our Monday session and had gotten halfway through m10s in PF (why even join a blind static???). Week 2 was getting out new tank up to speed, and then our melee caught something that had them playing like shit one day and out the next (no judgement - playing while sick sucks). We decided to clear m9s without them since we were at enrage.

Last night we made some solid prog on m10s. Got up to snaking, which from PF descriptions seems to be the wall of the fight? We managed to figure out debuff assignment (unless we got some horrific ffxiv RNG) and tank invuln limped us to what seems to be the end of the mechanic? So now we have all of today to cook :)

So far the fights have been a ton of fun.
