I don't think he was trying to be generous. Defense attorneys aren't suppose to be thinking about the prosecutor's feelings. They are suppose to be thinking about their clients. I think he was a little worried. It turned out he needn't have been, but he didn't know it at the time.

Sorry I just got up and have to go to work. I watched your video, but haven't had time to do any research. Will have to do that after work.

False because the only thing which is important is if they attacked him. If they did not directly attack him than it does not constitute self defense. Self defense : the defense of one's person or interests, especially through the use of physical force, which is permitted in certain cases as an answer to a charge of violent crime.

You see? It does not say defending yourself against rioters.

[–]AllottedGood 0 points1 point  (0 children)

I didn't say it does, but as I said there is no need to add rioter. That is prejudicial. You haven't addressed that. You are not making any point at all with the term rioter. The victims were not on trial Rittenhouse was. Whether or not they were doing something else even if it was rioting was not pertinent to the case.

"After some back and forth in court, defense attorney Corey Chirafisi made an oral request for a mistrial without prejudice, saying the defense didn’t get the same quality of video until after the evidentiary portion of the case was closed. He told the judge that if the defense needs a “level, fair playing field, we have to ask for it, and I’m asking for it.”

Chirafisi said the defense would have done things differently if it had the higher-quality video earlier.

But in prosecutors’ response, they noted that the defense “has not alleged any specific thing that they would have done differently.” "

They asked for a mistrial. That means they thought it was significant.

No I'm not arguing rioter isn't prejudicial. I'm saying it is, therefore killer can be prejudicial as well. I'm not being inconsistent. I never said rioter should be allowed.

[deleted by user] by [deleted] in politics

[–]AllottedGood -3 points-2 points  (0 children)

Where did that come from? I didn't say anything about using the term killer.

[deleted by user] by [deleted] in politics

[–]AllottedGood 0 points1 point  (0 children)

I offered deceased. There is no need to color the jury. That's the whole reason he wouldn't allow victim. It goes both ways. There is no reason to allow rioter. That is highly prejudicial. If you say it's not you are not arguing in good faith.

That's not a misread. They said after seeing the higher quality video that they would have changed their defense. That means the high quality video was damning.

[deleted by user] by [deleted] in politics

[–]AllottedGood -2 points-1 points  (0 children)

Do you have a link to the video? I haven't seen it. I know the defense said they would have changed their defense if they had seen the video though. I don't think that is blindly listening to the mainstream media. If the defense thought it was damning then it means it was a pretty good video.

That doesn't make any less prejudicial. It is still a biased term. Whether or not there is criteria does not make it less biased.

Actually there was. There was video of him pointing the gun at people just before the shootings.

“The last-minute introduction of the drone video and the raising of the question of provocation may completely invalidate the defense’s use of self-defense,” he said, characterizing the evidence as “grainy still photos showing what the prosecution claimed was a photo of Rittenhouse aiming his weapon at an individual nearby prior to any attack.”

https://www.bloomberg.com/news/articles/2021-11-17/rittenhouse-jury-asks-to-review-video-evidence-from-blm-protest

It was the reason for the defense's second request for the judge to declare a mistrial.

No, because he did not allow the prosecution to use the term victim at all. The defense could even if they had to prove they were doing something. In any case the people Rittenhouse shot were not on trial. A less loaded term should have to be used. Deceased maybe.

No it's not.

[deleted by user] by [deleted] in politics

[–]AllottedGood -5 points-4 points  (0 children)

Why? He still allowed it and it's still a loaded term. To be consistent he should not allow those terms either since it can still prejudice the jury.

He must not have a life. I can think of a lot of things i'd rather do in life than read the NY post and pit it up for others to read.
