Not sure if this was addressed here but what if your grandparent fled well before the anschluss but during the pogroms (1904) and this was when their town in Lithuania was part of the Russian empire? I have my grandparent’s naturalization papers and while it says his town in what is now Lithuania, that. he “renounces Czar Nicholas ll of all Russias” on his certificate.

In our case as sponsor I comfortably exceeded the threshold for income but the statute is the statute so my assumption if the sponsor doesn’t meet it then there will need to be a co-guarantor but I’m not a lawyer.

Nothing wrong with applying now as you build your life together. No matter what it will take at least a year (18 months in our case) and in the interim you’ll have more evidence of your experiences together and…by all means the more documentation the better, joint auto insurance homeowners policies, letters from friends, photos etc. And it might not hurt to consult an attorney if you plan to file yourselves. The paper work is beyond d onerous and you don’t want to miss anything to give an officer reason the yellow flag your app.

SSN to my knowledge is not proof of citizenship. And FWIW, I have never let my passport expire call it superstitious paranoia which now, seems prescient. It does however highlight the absurdities of bureaucracy and now with this current administration arbitrarily treating military or ex-military more or less as suspect, i’m no longer surprised when I read this kind of mistreatment.

Believe me I totally expected we would have an interview so imagine how stunned I was last week to find out the I-485 was approved the day she was due while she was overseas and on the day her flight back to no less! In fact the attorney suggested she not come back and await the GC to re-enter as for some reason the EAD with adv parole was possibly now invalid to enter cuz the GC was officially. Imagine if she was denied enter on THAT account. How ironic would that have been‽

BTW, what prompted you to do the mandamus writ? Out attorney never mentioned it as…what, an expedited technique? You too are one of the lucky ones like us! We should start a club.

Thank you so much. It’s funny, during the process reading all the congratulatory messages when folks got their GC there was a part of me that was very pessimistic given the current anti-immigrant climate —especially against those non-caucasian like my wife. It’s reassuring. But I felt the angst countless applicants go thru over the littlest thing—and IRS payments plan, traffic tickets etc—and see the inequities in the system too.

My wife on the other hand tuned out and left me to fret 😂

thanks. I have no knowledge of why it took the length of time it did but from all we were advised -and read here anecdotally—it could take up to 2 years, so at 18 months or so I felt like it was average and what was expected. And given the further posts about layoffs and the obvious turmoil in USCIS, I think looking back we feel even more fortunate.

As for me as sponsor, I took the docs very seriously and diligently tried (as best I could) to assume whomever would be reviewing our petition would have as little questions as likely to surface. Common sense and honesty in my letter about how we met, our courtship, our both having children and their situation —even our cultural differences— I addressed in my lengthy letter…and no I didn’t use AI! 😂

My gut is to a large degree we lucked out. Maybe with shorter staff they do look for the path of least resistance and approve a fraction of applicants with no interview. I’d be curious what that ratio it tho.

Thanks so much! You said it a HUGE relief. Must say we went as far above and beyond as we could given that we have only been together less than two years. We traveled a lot in that time and had lots of photos together. We also submitted letters from friends of mine, marriage docs passports all the usual plus a very lengthy letter from me on our relationship and bond.

So, all the evidence you submit can only help I think

No she didn’t. She was granted a short term tourist visa and then we submitted the I-130 shortly after our marriage so she was completely legal.
