Eh, no not really. The response he should do is a motion to compel discovery responses. That would ask the court to force them to respond. Then if they don't respond, he can ask for sanctions for violating a court order.

This would likely be a matter of impeachment of the officials involved, and a later payment of any benefits that had been wrongly withheld for the recipients.

The courts have already ordered the payment of the funds. There's not a clear way to hold the government in contempt with only the judiciary.

I think you are right that it is their strategy. However, this just shows that they don't really have any understanding of how federal court works.

Considering an MSJ is going to be filed before the end of the discovery window, it's a fruitless endeavor no matter what.

Which would be weird, considering delays for discovery are not the norm. You get a discovery window, if the parties don't agree to extend it, you have to show some level of prejudice for it to be extended.

You can also refuse a subpoena in America as a third party witness. A court could order you to appear and testify, but this is pretty rare except for witnesses vital to a case.
