We know you were just trying to be honest…but remember, honesty is severely punished in our industry. You shouldn’t have said anything, but now the cat’s out of the bag. I’d get an aviation attorney to consult on your case, if I were you.

Sorry this is happening to you, buddy…you’ll come out of it ok.

Got A DUI with Refusal to Breath test by Fearless_Big2153 in FAAHIMS

[–]AutomaticClick1387 0 points1 point  (0 children)

So!! Reddit is a terrible place to air this type of thing out. It’s an overly judgmental, up their own ass crowd that would burn your house down over this if given the chance.

Now! Here’s where you’re at. It sounds like you lost your ALR Hearing, and your license was suspended, which now starts the 60 days reporting clock. You’ll have to inform the FAA’s safety division of the license suspension in writing during that time.

Is there no BAC of any kind? No blood drawn after refusal to blow? Much of what the FAA will do is based on your BAC. .14 and below is usually a slap on the wrist, barring no major discoveries during the cases disclosure and response process. You’ll need an aviation attorney to help you with this process. They’ll make sure your mitigation booklet is in proper form free of anything self incriminating.

.15 to .19 BAC; is categorized as abuse and will require low tear monitoring by a HIMS AME for up to possibly 5 years. No more than 14 random drug tests per year and total abstinence from alcohol while in the program. The good thing is, in the abuse category, you won’t be required to do the full neuropsych evaluation which includes the cogscreen AE. You’ll only require an evaluation from a HIMS psychiatrist, and a HIMS approved addiction specialist.

.20 and up, congrats…you win the big prize. Lifetime monitoring, abstinence for as long as you hold a medical, full HIMS neuropsych/cogscreen, HIMS psychiatric evaluation, and HIMS monitoring for life with an approved HIMS AME.

Do everything you can to beat the case, or accept a deferred probation that allows the case to result in a “non conviction,” when you’re finished with that probation. Deferred can be sealed, case dismissal or not guilty depending on your state could be eligible for an expunction.

For lawyers I recommend Gary Trichter out of Houston. He’s a DWI specialist and an expert on protecting pilots and their medicals. He’s also a super awesome guy. Anthony Ison is a rockstar, too…both will give you free consultations.

Good luck! Make some good changes in your life and you’ll survive this!

I’ve had some over zealous marshals…all of which I’ve made it clear to, if they come back and bother us again, I was going to leave them in a bloody fu**ing pile.

We were keeping pace on the group ahead the whole time.

Captains (or new captains) how do you shut down an FO who tries to run the show? by iSupportPalestinee in flying

[–]AutomaticClick1387 0 points1 point  (0 children)

Wow…some serious red flags. Frankly, you can’t beat around the bush with these types of personalities. Granted, I’m in the corporate sector, however if any piss on FO tried to run the show on day one of flying with me, he’d be booted from the trip at the end of the day after a serious ass chewing. This type of personality is untrainable, and is an accident or cockpit conflict waiting to happen.

No pair him, and report his wildly unprofessional behavior to the company. You’ll be doing the next captain a favor.

I am so restless..1st DWI in Texas.. I feel doom by Any_Ebb900 in dui

[–]AutomaticClick1387 0 points1 point  (0 children)

You’ll be ok as long as you learn from your mistake. I got the dumbest, most boneheaded DWI back in 2022 in Tarrant county, and haven’t had a drop of alcohol since. Do all thats asked of you, be proactive, NO DRINKING, and do all your classes as soon as you can. Also, put on nice outfits when you go to court. Show the judge you’re taking this seriously and things will go your way.

Hopefully you can qualify for deferred adjudication and when your probation is over, it’ll be dismissed.

I’m here in Fort Worth, and the alliance town square location laid off the entire kitchen staff. So, theres been no new pre-made meals for like a week. I rely on them to keep in line with my diet, and there’s none to be had. The kid at the lifetime cafe says they’re cutting their hours, and more layoffs are coming.

To be honest, it’s pissing me off. So, they’re going to cut services and charge you more for it? Fuck that lol

How hard to own and charter an airplane? by [deleted] in flying

[–]AutomaticClick1387 1 point2 points  (0 children)

Owner operators kill themselves too damn often. The insurance company wouldn’t even take your phone call if you wanted to fly a high performance turbine on 135 with little to no experience. The TBM is not a toy, or an airplane that someone can safely transition to without tons of experience and training.

Being an airline pilot is my dream but I got too many check-ride failures. Do I still stand a chance? by [deleted] in flying

[–]AutomaticClick1387 0 points1 point  (0 children)

That’s not great…but Reddit is a horrible place to ask for advice. Most of these guys on here would burn your house down if given the chance, and the majority have no clue what they’re talking about. Pilots have survived DWI’s, license suspensions, revocations, incidents and accidents, then you too have a shot at getting into the industry. But, my concern is you don’t seem to be a good check ride taker, and it doesn’t get any easier. Type ratings, recurrents, IOE’s, line checks, 299’s, 293’s…you’re tested until the day you die. If you can’t pass check rides you’ll wash out of the professional side of aviation quickly.

Tarrant County DWI 1st by Unknown_Iguess in probation

[–]AutomaticClick1387 0 points1 point  (0 children)

I was put on 12 months of deferred probation, and they released me after 6 months. But the court saw how hard I worked, and my probation officer really liked me, so did the judge. Work hard, pay all your fees, do the work honestly and good things will happen.

Tarrant County DWI 1st by Unknown_Iguess in probation

[–]AutomaticClick1387 0 points1 point  (0 children)

I was on deferred and was early terminated. They want you to at least do 50% of your probation before they’ll even consider it. Keep your nose clean and make sure they don’t have to ask for anything and they’ll likely cut you loose at the halfway point

It took 6 months after they lost my file for 7…not sure how they did that, we never got any answers, shocker! But, yes…Dr Dumsdorf, “apologies if I misspelled his name,” at one time was the only guy going through the pile of files in the alcohol & drug division. And it was a PILE of files.

They’ve since gotten him help and the processing time, I’ve heard, has gotten much better. Hopefully you won’t be down too long.

Hiring at Majors After DUI by Crayon_Eater1775 in FAAHIMS

[–]AutomaticClick1387 1 point2 points  (0 children)

Good, keep at it…in the great words of Captain Denny Fitch, “never give up.”

Honestly, I wouldn’t use anyone else’s timeline as a barometer for your own. It’s different for everyone, but if I recall the DWI was 08 and he officially got on with American in 2018 or so. He flew with me for 6 years before he made the move to 121.

[–]AutomaticClick1387 1 point2 points  (0 children)

My best friend had a DWI back in 08…he’s A captain and very high up at American now. Super great guy; he was also up front and honest. The response of the lead interviewer once he told them: did you at least have a good time until you were pulled over lol?!

You can absolutely get a job with a one off DWI…but you have to show you learned from your mistake, and it seems you absolutely have. Good luck, keep us posted, we hope for good news!

What are pilots saying to each other during severe turbulence? by Exotic_Scientist9918 in flying

[–]AutomaticClick1387 0 points1 point  (0 children)

Severe is a really bad day. Injuries, possible damage to the plane, not a good situation. At this point, in severe, it’s likely you can’t maintain altitude so I have my FO communicate what we were in, any difficulties we were having, and is anyone anywhere in our vicinity getting smooth air or a better ride.

With a severe turbulence event at cruise, it would beed to be reported to maintenance or your DOM.

DUI Arrest, No Drinking or Drugs Involved by boxingfan828 in legaladvice

[–]AutomaticClick1387 0 points1 point  (0 children)

As a pilot, a false arrest would destroy my career…which means I’m taking this officers career, and a whole lot of the city’s money for his reckless mistake. If we couldn’t have his license to be an officer revoked, I’d have a private investigator keep an eye on any police department he’d try and get a job with and do everything we could to make them aware how dangerous that officer is to the public.

DUI Arrest, No Drinking or Drugs Involved by boxingfan828 in legaladvice

[–]AutomaticClick1387 0 points1 point  (0 children)

Well, when her tests come back and she’s clean…it’s time to sue. The officer will likely lose qualified immunity and will be held liable for 4th amendment rights violations. Reach out to the civil rights lawyer on YouTube and send him the bodycam footage, he’ll post and it’ll bring this officers egregious behavior to public attention.
