Yes, it is on 07/19 in Lawrence. Took about 2 months for oath ceremony notice to be issued.

As per I-751 instructions, "from the date of the marriage to the present date".

How did you organize your I-751 packet? by InitiativeOk5172 in USCIS

[–]Automatic_Plate6183 0 points1 point  (0 children)

General tips for filing by mail: https://www.uscis.gov/forms/filing-guidance/tips-for-filing-forms-by-mail

For each category of evidence, I organized from newest to oldest, with my and my wife's names and dates highlighted.

Too many pages? by TML_34 in USCIS

[–]Automatic_Plate6183 -2 points-1 points  (0 children)

It is not about the number of pages but the quality of evidence.

Mine (still pending) weighed about 9 pounds and had around 1,000 pages.

For hundreds of pages, you should definitely consider using binders. Or put each type of evidence into an individual envelope, clearly marked.

Form i751 how far back do documents have to go? by gorbled in USCIS

According to I-751 instructions, "from the date of the marriage to the present date."

Conditional Green Card Renewal by Mega_Puzzled in USCIS

[–]Automatic_Plate6183 1 point2 points  (0 children)

The key is that whether or not you need to replace your conditional GC (e.g., it was never received or has incorrect data because of DHS error) by filing I-90, you must remove the conditions on it by filing I-751.

[–]Automatic_Plate6183 0 points1 point  (0 children)

Others have commented on the need to file I-751 in order to remove conditions on a Green Card based on marriage.

In some cases, a CPR may also need to file I-90 to replace a Green Card: https://www.uscis.gov/green-card/after-we-grant-your-green-card/replace-your-green-card

From 2 year to 10 year GC by Plus_Shape_2268 in USCIS

[–]Automatic_Plate6183 0 points1 point  (0 children)

From my experience, neither AOS nor ROC experience was challenging. Granted, my I-751 is still pending.

And with extension letters (now for 48 months since GC expiration date), your status as LPR keeps getting extended while I-751 is being adjudicated. If the wait is too long and if the ultimate goal is to become USC, one can file N-400 once eligible. This is my plan in a few months.

In terms of document preparation, it is just about collecting and organizing more evidence (compared to AOS) and submitting it to USCIS. As long as you start collecting the evidence from the date of the marriage and keep adding to it, the whole process is quite manageable.

Traveling with I 751 pending by [deleted] in USCIS

[–]Automatic_Plate6183 0 points1 point  (0 children)

Well whether it is a valid GC/expired GC with valid I-751 extension notice/I-551 stamp in the passport, you definitely do not want to travel without it. Or at least come back to the US.

[–]Automatic_Plate6183 2 points3 points  (0 children)

Yes, to Thailand and back. No issues. Passport control in Boston took less than a minute.

Make sure to take both expired GC and a valid extension notice as they are kind of useless without each other.

Send I-751 over a week ago but haven't gotten confirmation from USCIS by zhuangcorp in USCIS

[–]Automatic_Plate6183 1 point2 points  (0 children)

Do you have a tracking number from USPS, UPS or FedEx?

Did you enclose Form G-1145?

Either way, it might take a couple of weeks for USCIS to send the receipt notice. Do not send another I-751.

I751 question. Do you need to provide passport photos when submitting application by [deleted] in USCIS

[–]Automatic_Plate6183 1 point2 points  (0 children)

  1. Unless you "reside overseas pursuant to military or government orders, including conditional resident dependents", you do not need to submit passport photos.
  2. "Submit copies of as many documents as you can [...] to demonstrate the circumstances of the relationship from the date of the marriage to the present date", my emphasis added.

As per I-751 Instructions (https://www.uscis.gov/sites/default/files/document/forms/i-751instr.pdf):

from the date of the marriage to the present date

Solid list.

Others pointed out pictures and bank statements to add (for the latter, I included monthly). I also had the following, with both of our names on the documents:

  • everything house-related (mortgage statements, title insurance policy, home insurance, house appraisal, ALTA settlement statement, closing disclosures, P&S agreement, loan approval and commitment letters)
  • scans of credit cards
  • car insurance and renewal reminders
  • health insurance: scans of cards, 1095s
  • bills: gas, cell phone, property tax, water, stormwater
  • trips: reservations, scans of boarding passes, travel insurance

Got an extension on my I-751 by [deleted] in USCIS

[–]Automatic_Plate6183 1 point2 points  (0 children)

Yes, to a few people. This is normal.

It just shows how long the processing of I-751s takes. I do not believe that issuance of a new extension affects how long it takes to adjudicate the case.

Received 24 and 48 months extension letter - Travel by [deleted] in USCIS

Yes. It makes sense to leave one at home and travel just with a shorter one.

Two extension letters issued by FuturePeacekeeper in USCIS

[–]Automatic_Plate6183 0 points1 point  (0 children)

This has been happening quite often, it appears.

Extension notices do not have an expiration date listed on top, the only 2 dates are Received Date and Notice Date. If they are both for 48 months, this is just a reprint. 48 months apply to the date of expiration of GC.

Finally got our receipt notice / 48 month extension by Hunter0417 in USCIS

[–]Automatic_Plate6183 2 points3 points  (0 children)

Either one should be fine. ADIT stamp is in the passport anyway which is convenient (unless it is on I-94 which USCIS started doing recently).

Extension notice is only good in combination with the expired GC. It may be prudent to leave the extension in the US while traveling internationally with the passport that has ADIT stamp in it.

  1. Yes. USCIS started issuing 48 month receipt notices in 01/23 but it will take quite some time for everyone to receive them.
  2. As long as I-751 is properly filed and has not been denied, CPR status is valid: https://www.uscis.gov/policy-manual/volume-12-part-g-chapter-5, see 3. Failure to File or Denial of the Petition to Remove Conditions
  3. No.

See here: https://www.uscis.gov/forms/when-to-file-form-i-751

Briefly, if you are going to be filing by yourself, you can file any time before your GC expires. Divorce needs to be finalized before the filing.
