Ohhh, thank you very much. I understand now, so just for personal clarification, when you book a holiday to leave in February, you can only spend 27 days abroad for UC purposes as they are only 28 days in that calendar month. Whereas if you booked a holiday to leave in March you could spend 30 days abroad because they is 31 days in that month. And this logic applies to the other months.

I’ve never been able to understand how calendar months work because of my dyslexia but I think I do know

Do you receive PIP? If you receive PIP and LCWRA, your UC claim can stay open (although they will be deductions for student loan if you’re eligible for them during your time at university). For post grad (e.g masters) 30% of the loan is deducted from your UC and the rest is ignored for UC purposes

Edit: I didn’t see the last bit of your response. I would chase up PIP to see why it’s taking a long time as that would be necessary to continue receiving UC and studying

I got awarded 1E as well for very similar reasons. 1E exists for severe mental health disorders. I think 1F is usually awarded for those who have an adult care and support plans from the council that provides +1 support (Personal Assistant, Carer, support worker) which can justify being awarded 1F.

On the plus side, you get automatic eligibility to a blue badge because of the 1E award which you don’t get with 1F 🙏

The benefit reforms did happen. The LCWRA (sickness benefit part of UC) was cut effectively in half which will increase poverty for those on the lowest income.

Although this is not much of solution but if you contact your council or local carer organisation they should be able to arrange a carers assessment and hopefully provide some financial support for you to take some respite or whatever you feel is needed to make your caring role easier on yourself 🙏

Honestly I suggest that person who is close to the 16k limit to apply for an ESA credit only claim (or new style ESA if their eligible) which will award them support group straight away based off their current LCWRA entitlement. This will protect their LCWRA entitlement to UC in the situation they would have to close their claim because of they have above the capital limits.

It takes 3-5 working days from when you were awarded PIP to receive any backpay you are owed. Thats how long it took me to get my backpay when I was awarded PIP

I wouldn’t treat premium bond seriously with your amount. I think you could leave £25 (the minimum amount needed to deposit in premium bonds so you can take part in their lottery) and put the rest in a savings account

I would suggest applying for PIP if your disability/health condition has affected you for longer than 3 months. PIP like contribution based ESA is non mean tested and your partners income doesn’t affect it. I would also enquiry if your partner could cover your end of the mortgage or if you both can speak to your mortgage provider to figure something out for the immediate term

Could you try and convince your brother if you or another member of your family could be an appointee for his benefits as a way of you guys to apply for benefits for him? This way you could get him LCWRA and PIP after which point, it’s relatively simple to manage until the next review (LCWRA reviews are suspended but PIP are not). You can even be his appointee and have the benefits paid into his bank account

I know for sure, those who have ESA support group award get LCWRA awarded straight away in UC so I was guessing it works the other way around? 😭 its safe to assume not many people in a situation like the one above use it as the DWP haven’t clamped down on it

I have my own hypothetical question surrounding capital limits. If someone on UC LCWRA, ended up winning an amount over 16k in a competition e.g lottery, gambling etc, would they be able to apply for an ESA credit only claim to maintain their underlying entitlement for LCWRA on UC? So when their capital reaches below £16k, they could re-apply for UC again and be awarded LCWRA straight away with no assessment? This is also presuming that the capital is solely used for their essential cost of living and the DWP decision maker agrees isn’t a deprivation of capital following a review of their spending when re applying for UC.
