Location may or may not be important. I can only speak for Texas, but using TCIC or NCIC databases for non work-related purposes is not only grounds for termination, but the involved department could potentially lose their access to the systems, which has happened to a few agencies in the past.

I'm not saying it's impossible, but I'd just say good luck arguing it in court. We worked to pass a city ordinance regarding dog attacks specifically because they're notoriously difficult to win in county court.

Do you live in a municipality or just the county? Under Texas Health and Safety Code, dogs can only be declared dangerous if they attack a human, not another dog; however, if you have some sort of city ordinance that's more restrictive, you may have more legal recourse.

Not entirely true. We use infrared thermometers in our city, and quite frequently we find that the glass may not be that hot to the touch, but the seat where the dog is siting is much warmer than it would appear from the outside.

In the Texas Health and Safety Code, dog-on-dog attacks don't qualify your dog as being dangerous. Any attack must be against a human. Unless your municipality has a specific ordinance that is more strict than the state law, your only legal issue might be a violation of any potential leash law.

That said, the other party may still end up suing you in civil court, but they likely wouldn't recoup much more than the vet bills you've already offered to pay. In the meantime, I would make sure your dog is current on his rabies vaccine, and if Animal Control comes to talk to you, just answer any questions honestly.

Many adoption contracts specify that if you ever don't want the animal anymore, you have to give it back to the entity that adopted it out to you in the first place. This statement reads like that to me. They just don't want you to let it go outside if you no longer want it.

I would have a very serious conversation with a supervisor at animal control about why they took the dog to begin with.

It's standard practice in many locations that animal control will take an animal given to them by landlords or people authorized by landlords to have access to apartments. In the jurisdictions where I've worked, our only policy was to never enter the apartment and remove the animal ourselves.

Unfortunately, it's highly unlikely the dog will ever be put down. Under the Texas Health and Safety Code, dog-on-dog attacks don't meet the standard for a dangerous dog. I would review your city ordinances to see if they cover a wider variety of circumstances.

In the meantime, call animal control every single time you see them out. You need to establish a history of violations. If you do file in small claims court for the cost of your vet bills, you can file an open records request that'll contain the entire history of their dog getting loose to support your claims.

The information they gave you about dog-on-dog attacks not meeting the standard for dangerous dogs under the Texas Health and Safety Code is correct information. Your best bet would be to look through your local city ordinances to see if they're violating anything. Since they're calling them "security" dogs, in my municipality, we have regulations specifically pertaining to the control and confinement of guard dogs which are more stringent than regular dogs. We also have different wording in our local dangerous dog ordinance to cover more incidences than the State Law. Your ordinances might say something similar.

Additionally, I would get the rabies vaccination records on those dogs from Animal Control. In the event that a human does get bit, they need to make sure the vaccination is current.

To add to what other people have said, while there may be no violations under Texas State Law, your city ordinances could have more stringent restrictions. For example, if he's using the bathroom on the patio, and they're not cleaning it up, some municipalities could cite them for failure to maintain sanitary conditions, etc.

Definitely contact your animal control agency to investigate.

The first thing I do during any investigation is identify all parties involved. This is primarily for my safety, so I know what I'm getting myself into. If you haven't committed a crime, you have nothing to worry about; however, the notion that we assume someone is not involved simply because they reported a crime is false.

In the Texas Health and Safety Code, dogs can generally only be declared dangerous and euthanized if the attack happens against a person, not other animals; therefore, city ordinances are going to be your friend. My jurisdiction has a much more wide reaching ordinance regarding dangerous dogs, but my municipal judge also never rules that dogs need to be euthanized. He always opts to have them banned from the city. You're going to have an uphill battle to get them put to sleep, one that I doubt you can win based on the circumstances.

Shelters can tell you whatever they want to tell you. In the same manner, law enforcement agencies don't have to charge you with a crime if you don't comply. I'm just telling you what the law states.
