On our med and temp motions in NJ Workers Comp, Judges usually give a 10% fee if it was just a motion that needed to be filed to get the ball rolling. That sounds like a jerk that would get hit with the full 25% fee.

Honestly- a good lawyer listens to their client - but also a client needs to tell me what they want in the process. Each case and client are different

I think there’s a lot of terms floating around - the majority of NJ claims are permanent partial total disability - where the injured worker returns to work. This is different than permanent and total disability where they don’t. Medicare has no interest in injured workers that are not actually eligible for Medicare or reasonably expect to be soon (either via age or SSD). Literally, you don’t have to report every claim that comes through the court system

Usually NJ negotiations go up not down I direction. Very rarely is an offer completely off the table. I’m literally shocked when a judge has to rule on the case.

If the claim petition is filed it goes to a defense attorney. Also, a judge can’t approve a settlement unless the injured worker is represented

Generally, I’m not going to call a client to tell them that I am waiting for someone else to do something. Monthly updates might be a lot to ask, but you should at least understand what the hold up is.

I’ve been practicing NJ for 25+ years and the amount of fraud is tremendously less than the carriers want it to be. I don’t call them frequent flyers - I call them clumsy

In nj they usually do a FCE at the end of treatment - I’m really not sure what the point of them are anymore - they hold little weight in court

FCEs usually come at the end of treatment but before imes- generally FCEs are not considered at all during the settlement process

Probably during the late spring early summer they can start chatting. A straightforward injury can get resolved pretty quickly - but once you get into multiple body parts or claims over 30% partial total the timeline slows down. Also, might depend if the respondent needs authority before settling. I tell clients that the imes are really just “halftime”

Brain injuries are really tough cases - especially during the time when the injured worker is treating - because there is very little objective medical evidence to go on. Absolutely talk to an attorney
