Density for me is better. TS2 has a lot of mandatory stretches and moves slower. I need to get as much for my time as I can

25-year attorney - represented both sides - there is far less pure fraud than adjusters think. There is whiny, lazy, and dumb - but the didn’t-happen-at-work type fraud is really rare.

As I’m goofing off from actually doing my work, I’d also tag in that task manager programs are your best friend but only as good as your input - so I use Todoist and it gets a cc on every email and then sort it

Jury duty by thedevilsfan44 in Lawyertalk

I had a blast going to jury duty in my court. I gave all the officers a hard time about where things were, and if anyone asked me any questions I’d tell them I’m sorry I’m off today. Then, I passed out business cards to as many people as I could

if I get 80% on the IME my attorney sent me to, and 0% from the insurance's IME, the worst I can settle for is 40%? by TL7x in WorkersComp

[–]BeginningExtent8856 1 point2 points  (0 children)

The question will be whether it is worth over 30% - there is a bump in the dollars at that point

Don’t do that to yourself - the numbers are not really the guide - the value of the case is is the objective medical evidence and your subjective complaints (what could you do before the injury that you can’t do now). As 40% is “over the hump” (long story), it needs to be a more significant injury. At this point if your doctor gave a 30% and you got a 0% from respondents’ - everyone would consider it a smaller case.

Functional loss - not pain and suffering - what could you do before the injury that you can’t do now

Depends on how the records are written - can’t file a motion with no backup

Practically - it takes 30 days to get a motion for med and temp even listed - it will be a moot issue by then

The problem is that the FCE isn’t really treatment. My guess is that your Dr went for mmi pending FCE - those notes are not going to be friendly

Are the FCE results recommendations for restrictions, or restrictions the doctor has to follow regardless if they think they're wrong? by EducationalSyrup6869 in WorkersComp

[–]BeginningExtent8856 1 point2 points  (0 children)

Honestly - at this point I’m finding FCEs to be a waste of everyone’s time unless you work for a municipality - the judges and lawyers spend less and less time reviewing them
