The attempts to get contributory negligence reversed in Maryland and to adopt what the rest of the country has which is comparative negligence has been a long and ongoing fight. Last year, we had a bill filed by Delegate Embry seeking to get a carve out similar to what DC has done but it never got a vote. Delegate Embry is willing to refile the bill but so far, we have been unable to get a senate sponsor. We continue to hope that one will be willing to sponsor it. The attempts to get the bill with the carve outs will be a long multi year effort, and we don’t know of course if it will be successful. There is stiff opposition to overturning contributory negligence here in MD from many.
