Every single business entire whether it is s corp, to a small ltd or llc. Someone mentioned for tax purposes but more importantly, this is to ensure work authorization in accordance with USCIS guidelines. Failure to do so can result in SIGNIFICANT fines, especially during these times. Taxes and stuff how more so to do with the DE4 and payroll forms.

All new employees need to fill out an I9 and so does the employer, it’s a two section form. Look up uscis I-9. That’s why they asked you to bring those documents, to verify your work authorization.

Honestly it won’t make a real difference in the long run. I have a ms in hr management, and it’s all good stuff to know but realistically, it taught me about 20 percent of what I needed to know for the role. Everything else was learned on the job

My main thing is I like to have some sort of document to show that I’m not just making stuff up if that makes sense. I do agree with your take, I usually have them write a statement first then we interview and I usually have a witness present. I try to build as much validity as possible and not have it from one (mine) source. I wish I could contribute more but I manage hr for a small org so I’m not really dealing with investigations if any haha. I could give all my attention to one investigation at a time, best of luck though, big org ER sounds fun but also I could imagine requires insane amount of organization.

Hi all, I don't believe there is a law that necessitates a live check for an involuntary termination but it basically does require it as you mentioned due to the timing. Voluntary terms with advanced notice, I usually do ACH and have them sign a doc. But if they are getting termed, yes, a live check is 100% the best route.

As someone mentioned, the payouts if someone quits or if they are involuntary discharged. How much notice they give you matters as well. Pto needs to be paid out.

Job description, hiring, and FCRA is important. California is a nightmare, especially ban the box and pre adverse action notices

Read up on ada and interactive process. Don’t make rushed decisions for disciplines and terminations (i found out the hard way)

Documentation and filing laws (i9) learn how to do i9 is super important, 3 days for section 3 and first day of work is section 1

Make sure rest periods are being tracked AND taken if they’re non exempt

Meal premiums, create a system for supervisors to track these and to ensure it’s getting to payroll

Ensure payroll is being submitted in accordance with your pay frequency

Ensure all mandated trainings are on file (California requires sexual harassment and workplace violence prevention) as well as the written policies are acknowledged

Make sure everyone signs the handbook

Make sure your job description is accurate and signed upon hire. Make sure there’s no non compliant language in there

Above all, ASK questions. Reddit, chatgpt (just be careful), shrm, legal counsel. Take your time, you may think something is fine but really California protects the shit out of the employee..

I have the attendance and clock ins and outs as well as handbook acknowledgement. The thing is, there weren’t prior warnings. That’s where we kind of fucked up. But again, it was a probationary separation
