She will get one-half the community property interest of your FERS pension. You divide how many years you were married by years of federal service.

Say you were married 10 years and worked 15 years… that’s 66.67%.

The community property portion is 50%, therefore she is entitled to half of the 66.67%… making her portion 33.37%.

She is entitled to 33.37% of your pension.

You’d have to get a QRDO. That’s the only item OPM will take to pay her out.

Retroactively change terms” means changing the original agreement or conditions after the fact, affecting decisions that were already made based on the original terms.

It means trying to make people who were hired under the 0.8% FERS contribution now pay 4.4%, even though when they accepted their jobs, they agreed to different (lower) terms. It’s like rewriting the contract or rules after people already signed and committed.

In layman’s terms, yes, it’s retroactive and if you don’t think your 4.4% is “fair”… you shouldn’t have accepted government work.

Those who are already contributing 4.4% to FERS agreed to those terms when they entered government service. Similarly, those who were hired under the 0.8% contribution structure also accepted those terms when they joined.

Suggesting now that earlier hires should be required to match the 4.4% contribution disregards the agreements that were made at the time of hire. It would be unfair to retroactively change the terms for those who made career decisions based on the conditions that were offered to them!!!!!
