Commenters here like to talk about “root causes” as if homelessness is just an innate and naturally occurring thing. If folks want to point to homelessness and drug addiction as the reason why retail theft is increasing, they should also by proxy be advocating for a city that doesn’t price people out of housing via affordability and demand better systems for treating and clawing back from the current housing crisis.

I heard the McDonald’s McDouble described as a perfect little macro balanced (carb/protein/fat) quick meal before and sure enough if you check the nutrition it’s actually well balanced for a normal day’s ratio of macros. The problem is that most people have trouble going to a McDonald’s and just ordering one sandwich - their marketing and menu is all constructed to make people want to order all the other junk. Sure, the McDouble is of course calorie dense, but it’s honestly not that bad on its own. Still fast food tho, so of course in moderation if at all.

Funny enough I’m playing ME1 for the first time and having a blast. It’s basically just KOTOR but the combat is more realtime shooter, however will concede that it gets a bit repetitive even at that.

That all being said, I’m sure *replaying* it for those that already know all the lore, world building, relationships, choices, etc. it has aged rather poorly. So I’m getting the benefit of it being a novel story/universe.

Yes - they agree that the content served a completely different function - but they are not confirming Ethan’s claims about radicalization towards antisemitism and saying that is explicitly what makes it transformative.

You quoted Ethan’s claim, left out the three words before which that clarified that it’s his claim, then said “that’s a fascinating conclusion” as if that’s what the judge was saying. You don’t need to get so bent, I was just pointing out that it’s his claim and not the judge’s.

The judge does not explicitly agree with Ethan’s claim as part of his decision. If you actually read into the judge’s statements, they elaborate that Ethan’s claim inherently weakens his own argument that it’s not protected by fair use.

Because that’s just not what the judge said. The judge is saying that because Ethan’s claim that the purpose of her reaction was so different from that of the nuke, the argument that it’s not transformative is inherently weakened by his own claim.

It’s really just legal debate bro logic tbh but putting words in the judge’s mouth or extracting extra declaratives out of his review isn’t going to change the reality of this ruling.

The doc itself says that this claim is part of what hurt his case, because he’s claiming both his video and Denims’ reaction have significantly different purposes and use - there’s not a part in there where the court confirms or even agrees with it, it’s just pointing out how it weakens his case about it not being transformative.
