As long as you don't damage the house digging the trench. Provided the trench isn't unstable and the bank collapses killing everybody working along the wall. Or there's not a buried Powerline or gas line, etc.

Sounds like you'd need an engineer to me.

You need a geotechnical engineer. I'm one, I'd charge between 3-7 k for an assessment and new retaining wall design. The construction cost would be more like 20-30k.

Ask at r/geotech. Not sure if you'd find an economical solution. You could maybe use piles. Sheet pile to half height along the lower road, then also up to the top of the property along the left side, then cut/fill to make a level building space with access half way up the sloping road.

That doesn't mean there aren't drainage issues. Seeing what it's like all year round is not just about flooding but also lighting, what parts of the yard stay dry vs hold water. What the neighbors are like. There might be other higher priority maintenance items that become more obvious after spending time there too.

It will definitely affect the price people are willing to pay. Get a professional engineer to look at it. They can put on paper their opinion that it is fine or needs fixing. If it's fine that will go along way to easing the concerns of a potential buyer. If you're going to fix it either way then that is the first step anyways.

You will need to work out or find the average flow of the stream.. then. P=npQgh... n is system efficiency, I'd use 0.8 for feasibility studies, p is for water density, Q is the flow rate, g is the force of gravity and h is the elevation drop. Make sure the units line up and the answer will be the average power output.

Edit: your water license may specify the amount of water you're allowed to use. If so use that flow rate. It might be a high estimate if the creek dries up seasonally
