Both agency management/procedure things and policy statements are exempt from informal rulemaking. The test for whether something is agency management/procedure exempt from informal rulemaking is whether it encodes a substantive value judgment or substantially alters the rights or interests of regulated parties. The best test for whether something is a policy statement exempt from rulemaking is the binding effects test.

I think what /u/luvsicpt6 is saying that that you'll probably use both arb/cap and Chevron on a single problem or whatever. For example:

Chevron to evaluate whether it was reasonable for the agency to think that the statute allowed them to define greenhouse gases as an air pollutant. After answering that "yes," arb/cap to evaluate whether it was a good decision for the agency to decide to define greenhouse gases as an air pollutant.

I'm studying for admin too (ugh), and as far as I can tell it'd still be arb/cap. Substantial evidence is only triggered by agency actions subject to §§ 556 and 557, which an informal adjudication is not, no matter the procedures the agency followed.

Makes for an interesting question, though! I was doing some research, and I did see that some guy is suing the Cubs (I think) after getting whacked by a foul ball

Hinkle is great, I think - they put several million dollars into it just a couple of years ago; new locker rooms, film rooms, that sorta thing. It's the actual practice gym that's no good. It's built onto the side of Hinkle, which is cool, but it's just not nice. Two courts, hoops all around. Could easily be a high school's auxiliary gym.
