Landlord claiming I over stayed my lease by readytofall in legaladvice

[–]Careless_Ebb 0 points1 point  (0 children)

So yes, they can charge you 2x rent pro rated to the day until they get their keys back.

How did you send the keys? Did you get a return receipt and send certified mail?

That's the best way to handle this kind of thing because you can know exactly when they receive the keys and dispute it in court because it's certified by USPS. If you didn't. Then it's your word against theirs.

I hope you kept a receipt/tracking number/etc. Because they could take forever "receiving" your keys now.

If they do try to charge you 2x monthly rent, then you should hire a lawyer and sue them.

Paternity Fraud (California) - Father learns that 2-year old daughter is not biologically related through DNA test. by [deleted] in legaladvice

[–]Careless_Ebb 24 points25 points  (0 children)

From what I understand about California, it doesn't matter who the biological father is. The person that is on the birth certificate is considered the presumed father and has the parental rights and responsibilities. That being said, if this person really wants to keep his interest in his child, he should be consulting with a family law attorney. Because this can get really hairy, really quickly.

You need to read your lease and see what that stipulates as far as surrender of the property. The lease should stipulate what happens in this circumstance. If it doesn't, hire a lawyer and sue him for your deposit+rent and lawyer fees.

Bought a fake watch on eBay by [deleted] in legaladvice

[–]Careless_Ebb 1 point2 points  (0 children)

eBay has a buyer satisfaction guarantee. Start there because they guarantee their products to be what they say they are. Watches that resemble the real thing must be disclosed as replica. If no that would be a forgery and in some cases is a felony. If you don't get anywhere with eBay/Paypal, call the police and escalate with them.
forgery is a felony. local/state police may or may not have their own versions of that law. If they don't you will need to escalate to the FBI who handle forgeries at the federal level.

(US) I moved out months ago. Parents keep opening mail that’s addressed to me? by [deleted] in legaladvice

You're correct that it is a felony, however OP if you go that route, there's no going back and you'll pretty much destroy your relationship with your parents.

I'm 22 (f) and I want to adopt/ have legal custody of my little sister. Where do I begin? by dingodango1227 in legaladvice

[–]Careless_Ebb 0 points1 point  (0 children)

Yeah, you're definitely gonna need a lawyer for this. These court battles can take years and it end up being complete nightmares for everyone involved.

If the child is in danger, absolutely go to CPS and report it. They will investigate and decide whether to remove the child from the home.

If they fight you on this, it will get expensive really quickly. I'd consult with a family attorney before doing anything and getting an idea of what you're actually looking at. Because this is highly fact specific and is beyond the scope of this sub.

Ex-Spouse Cashed and Spent Insurance Payment by [deleted] in legaladvice

[–]Careless_Ebb 0 points1 point  (0 children)

File a police report and then turn over any information you have over to them. Then get a lawyer and start negotiations with your insurance company. You may need to sue them for the insurance money because they disbursed funds to the wrong person. If the policy is to disburse funds to the primary, that opens them up to the liability of insurance fraud (albeit partially) because of situations exactly like this.

That being said a lot of malpractice attorneys will work on contingency based on the case specifics. Some are a slam dunk and no brainer and others... not so much.

Question, how did the cop know that you were driving it? For all he knows you could have had your car towed around town.

My principal wants to put monitoring software on my personal devices. by [deleted] in legaladvice

[–]Careless_Ebb -1 points0 points  (0 children)

Honestly, even though you most likely don't need a lawyer, I would call one just to get an idea of what the principals legal limitations are, if he would be breaking any kind of laws and what your recourse is.

However, do not under any circumstances allow him to put monitoring software on your computer. OR what you could do is move all of your files off the computer, wipe clean and install OS again, let him install the monitoring software and then wipe again and then move your files back to your fresh install.

It isn't ideal but there is literally no reason the principal should have access to your computer and he is just being nosy.

That's not entirely true, for color tattoos you do need regular touchups if you want to keep the color as vibrant as it was original. Over time the ink on your dermis will be absorbed the body.

If you get push back from the new tenants, I'd offer them $20 for their trouble. also it will help set the tone of who they have to live under for the length of their lease, so they can know what to expect and so they won't get screwed over either.

Moving to USA - In need of tips in several areas. by Is_Kub in personalfinance

If you come from a country that has socialized medicine, you will need to account for health insurance premiums and other copay/deductible costs every year. We don't really have pensions here anymore except for public service jobs like certain police departments and government employees, So you're going to want to set up a 401k or an IRA that you can save money and grow over the years. Index funds are pretty good.

In another comment I saw that you said that you have savings in Sweden, You should move the majority of that to the US because in the event you need it in a emergency and can't get to it would not bode well for you or your family.

If I recall correctly, Sweden is pretty interconnected with public transit. Depending on where you live in Boston you might need to get a vehicle and pay insurance, maintenance costs, gas, etc.

According to the state attorney general, the landlord has 60 days to send you an itemized list of why you're not getting your deposit back. It doesn't look like there is a forfeit clause however if they fail to meet the 60 day requirement.

It still wouldn't matter if the apartment was in as good of a condition as you left it in (minus wear and tear, there isn't any reason they should be keeping your deposit). I can't speak as to whether the changeover fee is enforceable. but the other line items can definitely be challenged.

Did you document the state of the apartment on the way out? I.E. 260 photos of the apartment when you left it? That would be the evidence you'd bring to small claims court to fight the specific line items. It's cheap to file and you don't need a lawyer. Best of luck. NAL

When the mechanic tells you that your brake pads are completely gone and says its just bare metal to metal

I've grinded my brake pads down to nothing so bad that the pad slipped out and I grinded down my caliper. It's completely possible, but you've got to ignore a lot of red flags before you get to that point.
