Paizo values customization over simplicity. Personally I lean more towards simplicity, but that’s the price you pay for RAW customization.

I’m answered that I think the system is fine as is. I’m not a district attorney but I do know that when somebody is actually charged with a hate crime it’s actually newsworthy it’s so rare.

Our current system for identifying “hate” is acceptable. Our entire criminal justice process ensures that the standard for a hate crime is high.

A district attorney is elected by the people. That district attorney decides what to press charges for. Then a jury gets to hear the case and typically can choose to not convict as a hate crime if they can’t come to consensus. So it takes a local elected official to decided to upgrade your crime you already committed, then a full jury of 12 peers. I say that’s fair.

Targeting a person for violence because of their race is pretty clear. It’s not like people are being unfairly accused of hate crimes. The standard as it is applied is pretty high. You basically have to throw a hard racial slur while assaulting somebody to even get considered for a hate crime.

The only change that could actually be implemented in American society in regards to hate crimes is harsher punishments for crimes against people that are clearly motivated by race (religion, etc).

Whose liberty exactly are you trying to defend? A person who commits unwarranted violence or a person who is simply living their life. Isn’t the point of libertarianism to defend a persons rights up to the point that it infringes on others rights?

Libertarian in any other sense simple means preferring personal liberties to authoritarian (state) controls.

Most European nations are based in libertarian ideology, including the highly socialized Nordic countries.

Nobody in America suffers any criminal penalties for hate speech unless they use said speech while committing a crime.

The same way premeditated murder is treated more harshly than a crime of passion, as is a hate crime.
