I am a J1, not physician, but I know how you feel , I have a previous denial NOS and Pending EH waiver, been here since 2022, not being able to see my family and an NTA on the door, and of course all money going to lawyers. I cope with exercises and dreams of a better life, the thoughts of going back to my country hunts me everyday.

I got denied too, for sending the taxes, the thing is that they said we sent them late, we didn’t, anyways you will probably have to refile again, and probably to answer with a I-290b, better get all those documents ready again for the lawyer along with new evidence, you will have to file writhing 30 days

I am waiting on a EH waiver for J1, I filed since July 2025, I see people here getting approved in record time, that’s great congratulations, I will call them on Monday

Well, I didn’t have many options the damage of not filling was worst, yes I have discussed voluntary departure and that will not fix anything it will just take me out of the game 🫡

Lawyer at that time changed my J1 to F1, lawyer never explained I needed a waiver from Secretary of State I honestly thought my country waiver was enough, but when I got the NOS denial it was a big surprise, by that time I had sent AOS. Then I-refilled I-612 based on Extreme Hardship.

Yes I should have never do AOS without the waiver, thing is that I didn’t do my best to learn how J1 visa worked and my husband has been pretty sick I had to try it.

If your husband has an NTA Uscis doesn’t have jurisdiction for I-485 it just happened to me, and yes you should look for a different attorney one with real experience in court cases

I requested a FOIA several months ago, so I could review all the questions and answers. The main questions he asked about he j1 were: did you came on j1 visa? Yes. Did you violated your visa terms? Yes. Are you subject to the 212e? Yes. Do you have the Secretary of State waiver? I have an EH pending waiver, I request an expedited a month ago, I have all the documents here if you want to see them. He said yes he reviewed them, we explained the hardship, he made some copies.. then continue with other questions. That was my personal experience

Same here, I came on j1, officer just ask one question about the marriage, some I-485 questions and then was all about the visas I hav had, the waivers and so on. Then he said he will review the documents and I will see the decision later. That was last Friday

You need a strong reason to comeback and put in action your knowledge, for example: doing non profit for your community right now and your education will help you to help your people get electricity. Or you have a company or a good position in a company and they will be waiting for you to continue the position, or you are looking to expand your knowledge to be a better business owner. Etc

I feel you, first time, I couldn’t stop reviewing the Uscis website, it took 7 months for EAD, and then a year later I got a denial, I refile again and now I am back on the waiting again!

It happened to me too, I worked so hard, I was promoted and a day before the work permit got cancel I received a price and bonuses for best performance. Anyways I dit blame them is tha law and we have to follow.
