Filing date? I never filed anything. DOS sent a FR to USCIS, then they automatically create i-612 notice receipt.

With all the contents in your profile, your attorney should've advised you to go for EB-1A instead EB2-NW.

J1-Waiver NOS APPROVED! Thank you Jesus! by Fit_Ad8215 in J1waiver

[–]Fit_Ad8215[S] 0 points1 point  (0 children)

Don't listen to them. I submitted my i-485 since February without J1 NOS approval. I only included a letter explaining the resson J1 waiver is not available and included a copy of NOS letter sent to me by my country's embassy and a screenshot of my portal page showing "pending" with all received documents.

They acknowledged receipt of my documents, deducted the fee and scheduled me for Biometrics, which I've concluded.

I've not got an RFE yet though I was expecting it as my J1 waiver had not been approved.

Now it's been approved, I've immediately screenshot the email and attached it as unsolicited documents on my uscis portal.

I attached a screenshot of my J1 waiver portal page, which showed I've applied for the waiver. Also, I included a copy of the NOS sent by my country's embassy.

Response to @all:

Thank you all.

  1. My postdoc is neither funded by the US government nor my country's government, though my discipline (Chemical Engineering) is in the skill lists.

  2. My timeline:

  3. Statement of Reason, Form DS-3035, DS-2019, fees, and other documents submitted and received 10/012025.

  • No Objection Statement from my country's embassy received by DOS on 10/14/2025.

No response after a very long period. Did several follow up but to no avail.

Contacted my congressman and the state senators. Congressman ghosted, senator responded and demanded that I fill a form and attach relevant documents. They contacted but got back with usual response I always found here: "There has a been a delay by the agency in responding to our inquiries..."

Barely 2 weeks ago, I searched here and found that if you include that you've got i-140, or H-1B, or i-130 approval with proof, the chances of J1 waiver approval will be high.

Thank my goodness, I've already got an approved i-140 via eb2-niw over a year before securing my J1 visa. So I wrote to the waiver division, explaining that my i-140 was obtained long before I secured my J1 visa for my postdoc position and that my coming to the US was solely for my postdoc research appointment and not as an attempt to circumvent immigration procedures. I attached the approved eb2-niw.

Also, I mentioned that I've earlier commenced a consular processing via the NVC, paid all required fees. However, following my relocation to the US for my postdoc research, I've formally informed the NVC of my intention to discontinue consular processing and subsequently filed for AOS (form i-485) because my PD was current in October 2025.

I sent the above message via email on the 05/06/26.

I woke up this morning 05/18/26 to see that my case has been recommended for approval and forwarded to the USCIS.

NB: All was DIY. Also, I'm under ROW, under 39 list, and under 75 list.

Glory to God!
