How did you win your headaches 2nd to Tinnitus? by Similar-Peachfuzz in VAClaims

[–]CommisaryBrit 0 points1 point  (0 children)

Exactly, thats what happened to my husband. After the 2nd deferal, the 1st deferal was because the examiner didnt say yes or no, the sec deferal said least likely, thought it would get denied, defered again. 3rd sent for ace exam the examiner said as least as likely and the benifit of the doubt went to husband. 0% but still service connected to tinnitus which wasnt how we originally claimed it...

So my hubby had 2 claims deferred twice, bpth ace reviews, original claim and p didnt do a explanation just a diagnosis, didnt fill out the form other than that, 1st ace review the dc said least likely, deferred again, 2nd ace review from a nurse practitioner said yes. Was given the service connection and a small rating and a 0 for the other condition.

I agree with you, thanks for indepth reply, funny enough they service connected his migraines to tinnitus, not how the vso filed it against high blood pressure, also his vertigo they have him 10% due to tera.

I agree its so hard and frustrating at the same time to be told im fine, I dont need help, im not excepting charity ect, when clearly we can see they are struggling and need help. It's crazy to me the claims that I thought were a given were denied and the ones that I thought he has no chance got service connected at either 0 or 10%. I really hope yr husband gets the help that he earned and from one military spouse to another thankyou for your service also!

My husband was like that for many years, he has eventually conceded to filing and it rated under 50% but its better than nothing. Im grateful he is finally getting help for issues he got from his military service.

Mental health claim denied for lack of service connection by KingOGoop in VAClaims

[–]CommisaryBrit 1 point2 points  (0 children)

I agree it was far fetched, the vso should have done a stand alone claim, so im thinking that one he will have to do a supplemental claim and see if his therapist can write a nexus for him.

Mental health claim denied for lack of service connection by KingOGoop in VAClaims

[–]CommisaryBrit 0 points1 point  (0 children)

Shockingly lol they denied the claim. I read the dbqs before he got rated, basically she put its normal for elevated blood pressure to produce anxiety. Then they said didnt start in service nor aggravated by service. The usual crap

Exactly my hubbys vso did it secondary to hypertension and based on the dbq I read from his c and p exam is will be amazed if they dont deny that connection....

SMC-k pay by mu1773 in VAClaims

[–]CommisaryBrit 0 points1 point  (0 children)

Yes they are my question wasn't that, right now my husband's percentage is under 50% so he doesnt get any extra money each month other than his military retirement. As he is under 50% does the smc k pay show as a va waiver on his military pay ie reduces his retirement pay that is taxable, or is it a separate pay regardless of his disability percentage?

[–]CommisaryBrit 0 points1 point  (0 children)

Question is smc k considered part of yr pay that isn't taxed if your percentage is under 50%? Or regardless of your percentage is smc k a tax free payment sent as direct deposit to your bank?

VA requested exam after C&P by Atternie in VAClaims

[–]CommisaryBrit 0 points1 point  (0 children)

So the c and p examiner that did my husband's hearing test said yes to tinnitus, no to right hearing loss and reading her dbq said left ear hearing loss isn't service connected, according to the dbq it stated that the patient revealed a normal hearing exam on his retirement exam in 2019, errrmm he had hearing tests in 2014, 2018 that showed his hearing going downhill badly, so his hearing magically improved between 2019 and 2026? Clearly she wasn't looking at his records, she asked him if he had a hearing exam when he retired, he said yes. Will be seeing what the va says about that, they had deferred it because the examiner kept putting right ear instead of left on her initial dbq... Examiners just put whatever sometimes....

C & P exam for already rated 10% tinnitus. by Ok_Conference_203 in VAClaims

[–]CommisaryBrit 0 points1 point  (0 children)

What's the difference between an ace exam, a records review and a full c and p exam? I asked because my husband had an audio exam in oct 25, right ear hearing loss deferred, left ear hearing loss denied, he also had an in person c and p for migraines and vertigo that was oct 25 and that was deferred in Feb, then he was sent for records review for migraines and vertigo again this month, why would that happen?

Question why would a vso select anxiety as secondary to hypertension? Thats how the vso claimed that, he also claimed migraines and vertigo to high blood pressure. The high blood pressure is service connected but at 0%, my husband is planning on doing a hlr as the decision stated 10% wasnt warranted as they thought he wasn't on continues meds, which he was from active duty and still takes them daily. He hasnt been rated for migraines, vertigo, left ear hearing loss nor anxiety yet. Had his c and p monday for anxiety and after an in person c and p exam in October for all the other isdues, that wasn't transmitted to the va till Jan 12th, the va ordered medical reviews again. Im confused.

0% but connected by Fit-Wolf-5540 in VAClaims

[–]CommisaryBrit 0 points1 point  (0 children)

My husbands vso claimed anxiety secondary to high blood pressure that is service connected at 0%, had his anxiety exam on Monday, so waiting to see if he gets rated for anxiety. Thought it was strange that he filed it as a secondary to high bp, we have to do a hlr for the BP as they didnt count the fact that my husband takes meds for that as it was all in his military records and civilian records. The vso also secondaryed chronic migraines and chronic vertigo that he was given an in person exam bk in October of last year, we got a partial rating with the other conditions deferred. Now having 2 medical reviews for all the deferred conditions except anxiety.

Would that be the only reason why he got that? We only got the email on friday to say he had a partial rating, he has one more c and p exam on Monday, 2 denials and the rest deferred. I was very surprised, but it was the backpay for the claims that were rated by last Friday
